Texas Gov. Gregg Abbot (R) created a law that Texas schools could not enforce mask wearing. Any school that defied Gov. Abbot's order would be punished. Dallas County Judge Clay Jenkins (R) then sued Texas Gov. Greg Abbott over the mask mandate ban and now schools can require students and teachers to wear masks. Texas school districts then immediately sent out notices requiring masks in schools.

Texas has the second highest number of COVID patients in the United States and the Texas school year has just started this week. Dallas County has only two available ICU beds in more than 170 hospitals. The COVID Delta variant affects children more than the Alpha and children under twelve cannot be vaccinated.
