I absolutely agree with you, especially about the “very black and white outright lie”. In the Duke LaCrosse (? sp) case, the stripper who accused the guys was extremely specific in her allegations with regard to 1) who the “ringleader” was. 2) what time the rape began, and ended. And 3) that the “ringleader” was there the entire time, because 4) after he raped her, he orally sodomized her near the end of her “ordeal”! However, the man she very surely identified as the ringleader was only there for the start of the show because someone screwed up and they didn’t have any money to pay her. He jumped into his car, sped to the nearest bank to use their ATM, and the bank has his face on camera quite clearly at the EXACT time he was supposedly raping her! Now THAT is an open and shut case of a false accusation! But NOTHING happened to her, NOTHING! @Willoughby23 instead of wishing and hoping for lowering the sentences for men who are actually CONVICTED of rape by a jury of their peers, why not aim your ire at the false accusers instead of two rape survivors? If it was up to me, that woman would have received the EXACT sentence that those poor innocent men WOULD have gotten if she wasn’t so damned specific about the time… 25 to LIFE! Also, Chris is exactly right! When you add in the prison population (and why wouldn’t you?) the amount of MEN who are raped each year is about equal to the amt of women who report being raped to police!

For those who are falsely accused, or when its just her word against his but there’s no evidence.
You realize that evidence of rape actually extends to psychological being and not just on site evidence right? I was sexually assaulted myself and there was no evidence because he was sneaky on when he chose to do it. Hell to the no, I don’t believe that sneaky rapists should be let off
Why should we convict someone without evidence?
We shouldn’t, BUT there’s more in depth evidence that goes into rape, than just on scene rape. You think any rapist is open about them raping people? No. Most rape cases happen with no one in site besides the rapist and the victim.
@kyleelyn199723 Kyleelyn, there is no such thing as psychological evidence. The evidence of rape is inside you! Semen and vaginal tearing, but also bruises on your inner thighs, arms, and wrists. The problem is when women don’t report the rape, or get a rape kit! Wait years, THEN make a police report! I do sympathize with women and girls who waited too long and there is no evidence, but it’s pretty hard to prove anything without evidence, and we need evidence before we destroy an American’s life, or imprison him. So we should teach girls that if you are raped, YOU have a responsibility to call to police immediately and cooperate with their investigation. If you don’t, he didn’t get away with it, YOU let him off the hook!As for @Willoughby23 , Dude! Where are ALL these false reports? There are 350 MILLION people in the US. Half of them (51%) are female, (175mil) as many as half of us are survivors of sexual violence of one type or another! Most people can name one or two false accusers, (Tawana Brawley, the Duke Lacrosse player’s “victim”, Emmett Till, and Justice Kavanaugh.) Those are the big ones. However at the lowest end, 20% of women will be the victim of sexual violence at some point in our lives, up to as many as 50% when you include things like groping, (and why wouldn’t you, it’s sexual violence!) When compared to the number of women affected by sexual violence every year, false accusations account for basically a rounding error, statistically! But that doesn’t mean that it should be ignored. A false accusation will destroy the life of the man it happens to, much like actual rape destroys our lives! Look, I was raped by my uncle 3-5 times a week for almost THREE MONTHS! So I have every reason to be angry and bitter towards men, but “men” didn’t rape me, my uncle did! So I don’t “Believe All Women” I “Believe All Evidence”! So absolutely NO, penalties for rape should not be reduced? But the penalty for making a false accusation needs to be increased.
@CrazyGirl2 I disagree with that sorry. My sexual assault when unnoticed by others around and the person that sexually assaulted me got jail time just for my simple police report. Have you ever seen shows like the Steve Wilkos show and others? Those same shows have the ability to arrest rapists and thing rapists to light if they are indeed guilty of rape. How many women have came forward with their rapist after the fact? There’s a lot more evidence that can prove someone being a rapist than semen and vaginal tearing
Went unnoticed *
CORRECTION: Between 16% and 20% of women will be raped in our lifetime, NOT 20% to 50%. I regret the error, and apologize. My source became increasingly outrageous with the numbers they were using, so I double checked with the Department of Justice, FBI database and immediately noticed the error. My source included any unwanted touching, and was not jus focused on rape.
I did not suggest that tearing or semen were the ONLY forms of evidence. I suggested that psychological evidence is not evidence. By definition, psychological evidence would be your feelings, and feelings are not evidence. Look, we are both surviving an enormous psychological trauma, let’s not argue. Obviously a woman’s psychological state immediately after the rape could be testified to by the doctors and nurses who treated you, but that is not evidence that THAT man sitting in the defendant’s seat raped you… (or me, in my case).
@Willoughby23 We should NEVER convict a person of rape, or anything else for that matter, WITHOUT EVIDENCE! Again, read what I posted “I don’t #believe all women, I #believe all evidence!”
@CrazyGirl2 I once again disagree with that I am sorry. There’s certain behaviors and triggers that you can identify based on how someone has been treated/ what the person has caused. It’s literally like how they found out Nikolas Cruz (school shooter) that he isn’t mentally insane and more so just a sociopath
That has NOTHING to do with rape! And AGAIN, medical staff are allowed to testify as to the defendants (or victims) state of mind immediately after the incident, as well as the days following. But THAT is NOT evidence that Cruz shot anyone, it is merely done to prevent him from pleading not guilty by reason of temporary mental defect (temporary insanity)
Girl a test kit is not the only way to convict a rapist, sorry not sorry. Again in my sexual assault case, there was no test kit, it was a simple police report, I didn’t even need to appear in court and he got arrested.
The physical evidence typically presented is the medical examination of the victim that was performed as close in time to the alleged rape. The Commonwealth will also use DNA evidence that is unique to the defendant to help prove their case. They will call any and all eyewitnesses. Almost all rape cases are assigned to a detective who is trained in obtaining evidence in these types of cases. That detective will usually be called as a witness. The victim will almost certainly testify in every case and explain what happened. The statements of the defendant that show guilt will be used against the defendant in a rape case. Anything the Commonwealth can do to prove their case, they most certainly will do at trial.
Any other medical evidence that the Commonwealth has they will always use. They will also use any statements by the defendant that help prove their case. Any independent witnesses to either the alleged rape or describe the what occurred before and after the alleged rape can also be called as witnesses to help prove the Commonwealth’s case. So, the Commonwealth will use any and all methods and evidence that the rules of evidence will allow to prove their case. They take these cases very seriously and pull no stops to obtain a conviction.
@CrazyGirl2 and I am sorry you have been through this by the way. I really really hope you took steps to have your uncle convicted, but I can understand if you didn’t
Thank you so much for showing that you really care! Yes, my parents backed me 100% (it was NOT hard to believe me, I was pregnant with his child!) but they supported me FULLY, and they got me into therapy immediately. As for the legal stuff…. Reading what he said about me was in many ways worse than the rapes. But in most ways it was wonderful! So he blamed it all on me for “seducing him”, which nobody, NOBODY believed, because sadly my uncle was my dad’s identical twin! So his legal team pinned their case on the futile hope that a jury would think I seduced a man who was identical in every way to my own father, and do this when I was 12!!! (As it happened on my 13th birthday, any seduction MUST have happened when I was 12 and he was 45!) Anyway, when my lawyers forwarded discovery that he impregnated me, and I needed an emergency abortion, his lawyers told him his only hope to ever see freedom again would be to take a plea, as he was facing approx 150 charges, each with a 15 to life sentence! (One for each sex act he did to me, or made me do to him) He killed himself shortly after that! That obviously ended the criminal case, and I sued his estate, because everyone on my father’s side of the fam receives a trust fund, from the family trust. My parents felt that I was entitled to compensatory and punitive damages! Since he died, his trust was dissolved back in to the general trust-fund! That settled quickly, and I now received both my own trust-fund as well as my rapists trust-fund, when I turn 25.Thank you kindly for caring enough to want to know how I was REALLY doing, and make sure that he was (at least) in prison! I hope that you too were able to seek justice, and find it! I hope you find/found the peace, not that you had before (we never fully get THAT back, but still I hope you are doing well), with enough peace to be happy, and have a productive life and relationships going forward. All my love to a sister survivor, Laura 🥰
@kyleelyn199723 The fact that they arrested some guy just because of what you said Is exactly why the law should be more lenient. Whether it happened or not thats just wrong, the police just decided you where right with no reason to assume that.
No, you idiot! They arrested him because the semen they removed from me matched his DNA! Not to mention that paternity on the fetus showed that HE was the father! Say something now!
@kyleelyn199723 This guy CLEARLY has absolutely NO idea how grueling, prolonged, repetitive, or traumatic a police interview is when you say “I was raped”. @Willoughby23 must believe that they just say “are you sure?” And if you say “yep” the cops are like okey-dokey let’s arrest him! Jesus! After hours of medical tests and psychological questioning/crisis counseling, the police part begins (although with me a female detective was in the room the entire time). Things like “could you have misinterpreted the relationship?”, and “how are you so sure it was him” and on and on and on… THEN they interview him, and HE gets to give his side. Even then they don’t JUST arrest him, the meet with the DA, and the DA decides (after listening to tape recorded statements, and reading the written statements of BOTH parties does it proceed either directly to court, or in many cases to a grand jury where they procure an indictment. Meanwhile, the entire governmental structure must legally consider him innocent (until proven guilty in a court of law by a jury!) HTF did YOU think the process went? This is real life, not an episode of Law & Order where the whole thing is over in 50 minutes @Willoughby23
@Willoufgby23 ha! You want to look like a total idiot? Here you go: this man has a past history of doing the exact shit to another girl and I didn’t learn that UNTIL I called the cops on him and he got arrested and had to appear in court. Go fuck yourself.
@CrazyGirl2 aww ☹️ I hope you are doing okay. That story sounds absolutely terrifying
@Willoughby23 Bud you do realize that rape allegations go on trial right? This isn’t China
@kyleelyn199723 Thank you Kylee. It was beyond terrifying, (as I’m sure you know), it was like my own personal hell! At first, I was confused, I thought it was a joke, a trick! I thought that maybe because I was “older” now, I was allowed to hear “grown-up jokes” and I simply didn’t get the humor. Now, I wish it really was a joke.
lol wow downvoting this of all things?
Life without parole for rape is absurd
Rape is almost the equivalent of murder for rape victims especially. I feel life w/o parole fits well.
