I understand your point about false accusations, but false reports of rape are dwarfed by the reality of actual rape numbers! Some studies use the old FBI definition “forced penetration” but that definition means women cannot rape men, and they absolutely do! Women however, rather than using force and the threat of force, women rape men by Extorting them, (do it, or I’ll show the boss the real accounting numbers”, Bribery “If you don’t have sex with me, I’ll just tell your wife we are having an affair” Shaming “what are you, GAY?”, and Threat of Embarrassment “if you don’t, I’ll tell The entire school that you couldn’t get it up, and when we finally did have sex, you almost threw-up!”. So with approximately 20% of women experiencing sexual violence in our lifetimes, you need to stop and think… just exactly how many false accusations of rape are there each year? No on agrees on the percentages of rape accusations that are provably false, but federal estimates range from 2 to 10 percent. That may sound like a lot, and it is, but consider this, of the women who ARE raped every year and actually report it… ZERO percent are false!

Yes as @CrazyGirl2 says you have false accusations, however just remember you also have Attempted Rape, these don’t usually end up as stats either, an attempted rape also leaves mental and emotional scars and often almost discounted by society.

For a lot of girls (and guys), it’s ‘there but for the grace of God go I’ when they read or hear about a rape or sexual assault.

Yes false accusations should receive a better punishment, however not when a person is getting off on a technicality and EVERYONE knows the fucker is guilty but gets away with it, that is not a false accusation.

I absolutely agree with you, especially about the “very black and white outright lie”. In the Duke LaCrosse (? sp) case, the stripper who accused the guys was extremely specific in her allegations with regard to 1) who the “ringleader” was. 2) what time the rape began, and ended. And 3) that the “ringleader” was there the entire time, because 4) after he raped her, he orally sodomized her near the end of her “ordeal”! However, the man she very surely identified as the ringleader was only there for the start of the show because someone screwed up and they didn’t have any money to pay her. He jumped into his car, sped to the nearest bank to use their ATM, and the bank has his face on camera quite clearly at the EXACT time he was supposedly raping her! Now THAT is an open and shut case of a false accusation! But NOTHING happened to her, NOTHING! @Willoughby23 instead of wishing and hoping for lowering the sentences for men who are actually CONVICTED of rape by a jury of their peers, why not aim your ire at the false accusers instead of two rape survivors? If it was up to me, that woman would have received the EXACT sentence that those poor innocent men WOULD have gotten if she wasn’t so damned specific about the time… 25 to LIFE!
Also, Chris is exactly right! When you add in the prison population (and why wouldn’t you?) the amount of MEN who are raped each year is about equal to the amt of women who report being raped to police!

The minute you start taking too much mitigation in a proven crime, you reduce the deterrent and justice aspect.

Sure there are a lot of things that need to be worked on in justice for sexual crimes. But it's mostly at the police investigation and defence lawyer, level.

The sentences reflect on what is brought to court. Few rape cases make it to court.

I think rape needs to be split into two crimes. Rape is like grabbing a woman and ripping her clothes off and holding a knife to her throat and having sex with her as she screams no.

The whole i was drunk and i dont remember if i told my boyfriend i wanted to have sex or not, should not be rape, it could be a possible like misconduct or something but in no way should it even be associated with the kind of thing i mentioned above nor should it carry nearly the same punishments. The motivations the violence the results of the interaction are all completely different.

The problem is when women don’t report the rape, or get a rape kit! Wait years, THEN make a police report! I do sympathize with women and girls who waited too long and there is no evidence, but it’s pretty hard to prove anything without evidence, and we need evidence before we destroy an American’s life, or imprison him. Half of them (51%) are female, (175mil) as many as half of us are survivors of sexual violence of one type or another! Most people can name one or two false accusers, (Tawana Brawley, the Duke Lacrosse player’s “victim”, Emmett Till, and Justice Kavanaugh.) Those are the big ones. However at the lowest end, 20% of women will be the victim of sexual violence at some point in our lives, up to as many as 50% when you include things like groping, (and why wouldn’t you, it’s sexual violence!) When compared to the number of women affected by sexual violence every year, false accusations account for basically a rounding error, statistically! But that doesn’t mean that it should be ignored. A false accusation will destroy the life of the man it happens to, much like actual rape destroys our lives! Look, I was raped by my uncle 3-5 times a week for almost THREE MONTHS! So I have every reason to be angry and bitter towards men, but “men” didn’t rape me, my uncle did! So I don’t “Believe All Women” I “Believe All Evidence”! So absolutely NO, penalties for rape should not be reduced? But the penalty for making a false accusation needs to be increased.

I did not suggest that tearing or semen were the ONLY forms of evidence. I suggested that psychological evidence is not evidence. By definition, psychological evidence would be your feelings, and feelings are not evidence. Look, we are both surviving an enormous psychological trauma, let’s not argue. Obviously a woman’s psychological state immediately after the rape could be testified to by the doctors and nurses who treated you, but that is not evidence that THAT man sitting in the defendant’s seat raped you… (or me, in my case).

The Commonwealth will also use DNA evidence that is unique to the defendant to help prove their case. They will call any and all eyewitnesses. The victim will almost certainly testify in every case and explain what happened. The statements of the defendant that show guilt will be used against the defendant in a rape case. Any independent witnesses to either the alleged rape or describe the what occurred before and after the alleged rape can also be called as witnesses to help prove the Commonwealth’s case.
So, the Commonwealth will use any and all methods and evidence that the rules of evidence will allow to prove their case. They take these cases very seriously and pull no stops to obtain a conviction.

Thank you so much for showing that you really care! Yes, my parents backed me 100% (it was NOT hard to believe me, I was pregnant with his child!) but they supported me FULLY, and they got me into therapy immediately. As for the legal stuff…. Reading what he said about me was in many ways worse than the rapes. But in most ways it was wonderful! So he blamed it all on me for “seducing him”, which nobody, NOBODY believed, because sadly my uncle was my dad’s identical twin! So his legal team pinned their case on the futile hope that a jury would think I seduced a man who was identical in every way to my own father, and do this when I was 12!!! (As it happened on my 13th birthday, any seduction MUST have happened when I was 12 and he was 45!) Anyway, when my lawyers forwarded discovery that he impregnated me, and I needed an emergency abortion, his lawyers told him his only hope to ever see freedom again would be to take a plea, as he was facing approx 150 charges, each with a 15 to life sentence! (One for each sex act he did to me, or made me do to him) He killed himself shortly after that! That obviously ended the criminal case, and I sued his estate, because everyone on my father’s side of the fam receives a trust fund, from the family trust. My parents felt that I was entitled to compensatory and punitive damages! Since he died, his trust was dissolved back in to the general trust-fund! That settled quickly, and I now received both my own trust-fund as well as my rapists trust-fund, when I turn 25.
Thank you kindly for caring enough to want to know how I was REALLY doing, and make sure that he was (at least) in prison! I hope that you too were able to seek justice, and find it! I hope you find/found the peace, not that you had before (we never fully get THAT back, but still I hope you are doing well), with enough peace to be happy, and have a productive life and relationships going forward. @kyleelyn199723 This guy CLEARLY has absolutely NO idea how grueling, prolonged, repetitive, or traumatic a police interview is when you say “I was raped”. @Willoughby23 must believe that they just say “are you sure?” And if you say “yep” the cops are like okey-dokey let’s arrest him! Jesus! After hours of medical tests and psychological questioning/crisis counseling, the police part begins (although with me a female detective was in the room the entire time). Things like “could you have misinterpreted the relationship?”, and “how are you so sure it was him” and on and on and on… THEN they interview him, and HE gets to give his side. Even then they don’t JUST arrest him, the meet with the DA, and the DA decides (after listening to tape recorded statements, and reading the written statements of BOTH parties does it proceed either directly to court, or in many cases to a grand jury where they procure an indictment. Meanwhile, the entire governmental structure must legally consider him innocent (until proven guilty in a court of law by a jury!) HTF did YOU think the process went? This is real life, not an episode of Law & Order where the whole thing is over in 50 minutes @Willoughby23
