Are American police allowed to strip search schoolgirls?

Recently the UK police have come under criticism for strip searching a black schoolgirl at a school without her parents knowledge. A few people are a little miffed at this and there's the usual accusations of racism.
Would this be ok in the USA?

This was really poorly handled and those involved including senior level need a kicking.

not saying you cannot do this.

however, it’s a huge alarm even just looking at It from a business risk analysis.

she is under 16
she is not white
it potentially needs a strip search as it’s drugs.

that should get looked and those involved go, oh fuck this is a hot potato, how should we handle it.

it did not need a very quick response, even a drugs dog would have been quicker and less intrusive and not a press field day.

There was no risk to life, it was about Potential using not dealing.

It was also really a school issue, as if she was found with a very small quantity on her, nothing would have likely been done.

Also this entire thing of ‘smelt’ is crap way to do things.

School needs a review on how it manages its duty of care and the police involved need a kicking and a review on how to really fuck up and how they failed to realise the entire thing was a grenade waiting to go off.

Weird people saying that only female officers should be allowed. Just blind to the fact women can also take advantage of the situation. I don't think they should allow strip searches unless if you know it's high security stuff like a Airport were drug trade becomes a real problem.
However schools are more concerned about knifes and guns which are not really gonna be hidden up some kids butt like maybe a small knife but hey if there doing that they've probably already been flagged as a criminal and in one of those schools for that.
So there is no real reason to search at a school like that. Finding something in a place it shouldn't be and it be just drugs on a teen is not worth the risk it can provide for officers traumatising a innocent.

It's not that they should never, there may be circumstances where it does become necessary, but for an underage child they should always have a parent or guardian present (not a teacher, an actual legal guardian) and it should be done in a way that does not traumatise the child.

Honestly the police in England have a bad reputation for rasicm and rape (a police officer was charged recently for kidnapping, raping and I think murdering a woman who he followed on a Friday night 😐) but I will say American police take it to a whole new level! I suppose it helps them that the judicial system in America is literally built to persecute and discriminate against any non white citizens!

I don't know about USA but this is how I think, if one is making some sort of a problem then they get what they deserve, police in England in the main are doing a good job, most times things like this is brought on by how they are , what race they are shouldn'tmatter and race should never be brought into it

The laws differ from state to state.

Generally speaking, assuming you mean a minor, it would be legal if they have strong reasons to believe there is a crime. Even in that case it has to be done privately, by a same-sex officer and will be heavily scrutinized.

Quite frankly any officer resorting to strip searching a 13 year old would probably lose their badge unless there is significant reason they could not solve it another way.

Also as a last tidbit, often a strip search requires a degree of consent. Simply stating that you do not want this and that it is making you feel bad can completely remove any legal justification to do it.

Anyhow. Technically yes. Realistically no.

I doubt if strip searches are legal unless the person either consents or is under arrest. And who would consent? You can't just strip people to see if they 'might' be concealing illegal substances.

I don't think that would go over well in the U. S. Depending on what else was in the news cycle, the media would have a hay day with it and BLM would stage protests and riots.

It is not supposed to be okay. But I am quite certain that it happens. We have had officers get fired for arresting six year olds. So it isn't beyond reason that some out there think it is okay to strip search a 15 year old.

Well you know what they say; 2 nations divided by common language.

They have some different practices to us as well; Obviously I'm not 100% sure how things work in America but i believe the equivalent process there is called an autopsy but I don't think they do those in schools yet.

It’s ok. If they have probable cause, they can. We just need to have a law that if they don’t find anything, they are subject to a wrongful lawsuit. Can’t search without repercussions. Only places that are exempt from that are public travel places like airports, train and bus stations. And the prisons.

I strongly disagree about having laws that says they will get sued for not finding anything. That if there are repercussions for being wrong when doing your job, then no one would do the job. How many officers wouldn't arrest people if there was a chance they could be arrested for arresting them? Simply put, no arrests would be made until they actually crashed into the car and there was absolutely all the proof. Also, as far as I'm concerned about the racism part of it, that's just a distraction. They say lady justice is blind. I truly believe she is.

No. That’s accountable. There is none when it comes to law enforcement. There are officer out here doing things just because they can, because they wear the badge. Lol I don't know about you, but I truly believe that just because you are law enforcement, doesn’t mean you are above the law. Now, I think it’s illogical for there to be a law that says if you look suspicious, that’s probable cause enough for them to search. Granted people may be able to get away with somethings. But believe it or not, racism does exist in law enforcement. You may not have to experience it, but there are plenty of people that do. On a daily basis. That’s not the only issue or even main issue. You have mentally unstable people behind a badge that want the power over people. And we currently don’t have a good system to screen those people out. So hence, we have these problems time after time. A routine traffic stop, turns into an unlawful search because a police office is curious at but had no real reason to be.

I’m not one calling for defunding the police, or to push them out of the neighborhoods and what not. However, there still has to be some accountability when they choose a path that is silly. I can accuse you of something terrible, and if there is no merit to it, you can sue me for defamation of character. So, you can do that to me. But if a cop unlawful demands to search me without merit…. He can just say oops. Nah, I’m not about that.

Plus, your point… no one would do the job. GOOD!! It will weed out the ones that are unstable and there for the power. It will create a balance for people that actually want to help the community, protect and defend. Rather than a way to control, and to get people to do what they want. There are some police that want to do that. But I’m afraid that that number is small in the grand scheme of things.
