The decision of Roe v Wade was an error in the first place because it violated the tenth amendment. Its a sort of paradox. If you believe that abortion is a crime, then it can fall under federal jurisdiction. If you don't think it's a crime, but rather a "healthcare choice", then it falls under state jurisdiction. So the feds could very well ban it as a criminal act, but they can't force states to allow it because it isn't.
