This is exactly the kind of thing the far left would propose. They NEED chaos and crime to justify more government power, and they're completely indifferent as to who needs to get hurt in order for them to get it.

Even San Francisco "liberals" are *beginning* to figure it out - they just recalled one of the many George Soros- sponsored District Attorneys that was refusing to prosecute crimes, which has resulted in violent crime rising nearly 50% and property crime up over 100% in that city. Most people here are too young to know much about NYC, but in the 1970s, NYC was a blighted war zone, and was as dangerous as southside Chicago or Baltimore. You can watch movies made during that time, that were filmed in Manhattan, and you can see glimpses of how bad it was - bombed out buildings, streets full of trash, drugs everywhere, etc.. It got somewhat better in the 1980s but began to devolve again - until they finally elected Rudy Giuliani as mayor.
Giuliani, a former Mob prosecutor, was tough on crime, and he believed in enforcing ALL laws, including "minor" crimes like vandalism, shoplifting, and so on. This was initially unpopular, but it wasn't long before ALL crime began to drop significantly in the city. It turns out that if you hold criminals accountable, crime goes down.
The city absolutely rebounded. Money flooded in, culture flooded in, big business flooded in, and wealthy people moved to the city. The NYC of the late 90s and 2000s was incredibly safe, clean, full of businesses, and was a desirable place to visit or live. But... the residents failed to learn the lesson, and when Giuliani's terms were up, they elected a moderate liberal, who was much softer on crime - and crime grew - and then they elected a far-left liberal, and crime grew worse, and people began to flee again - and this was pre-COVID.

In other rapes the only harm is sexual penetration but even then there are nuances. It might be penile penetration or digital or even a coke bottle and the vagina might have been penetrated or just the labia. The vagina might have been damaged or there might have been nothing more than is consistent with consensual sex.
At the very blurred end it could have been a night of passion. It is very plausible that the guy thinks it is a night of passion and the girl thinks it is rape.
And then there is the whole inconsistent treatment of alcohol. A drunk girl cannot give consent but a drunk guy is assumed to have the capability of responsibility. Except for sometimes. Here in Australia a 20's something guy did rape a 14 yo girl but he had diminished responsibility because he was drunk. Had he driven a car being drunk would not give him diminished responsibility.
There is different possible impact on different girls due to different life experience. That 14 yo was probably badly traumatized for obvious reasons. An older woman with a lot sexual experience might write it off as bad sex whilst she was passed out. I have known some to have done so.
There is also the inherent nature of 'he said she said'. Usually there are no witnesses. Whilst it is often said girls wouldn't lie about rape, it does actually happen. In my home city a girl ran out of a public park screaming that she had been raped to some guys who promptly charged off. They found an elderly gay couple, one of whom they beat to death. True the girl didn't say 'that old fag over there raped me' but she wasn't even charged with excitement to affray despite her definitively not having been penetrated that night.
In Western Australia a wife wanted to be rid of her husband and conspired with her girlfriend to seduce him and then withdraw consent just before he ejaculated. It is fairly well documented he continued for ten thrusts to ejaculate before he withdrew from her vagina. He was convicted of rape.

Criminal court systems are meant to prove that someone committed a crime against someone, a company, the government, that caused irrevocable harm, or enough harm to affect the person or organization for years to come. I will say that just like any case the mental state, behavior of a perpetrator, environment, peer group, financial situation, family situation, should all be accounted for in every criminal trial. The only reason I say that is because we all react differently to outside stressors and there are times when psychosis happens and a person is not really themselves. Is that an excuse?
No, it's not. It should just be considered when it comes to the amount of time they will serve. They would still be guilty of a crime, which means they will still have to serve jail time, but I think a ladder of sorts would be good to have. So if someone committed the crime whole heartedly, and knew what they were doing, whether hurting a total stranger, or their own family, they would get the maximum sentence for it, and someone who suffered a major lapse in judgment doesn't have to serve as much. That way punishments fit the crimes and hopefully allow people to see what they have done and maybe rehabilitate so it never happens again. If they are not rehabilitated then time should be extended.
All of that is wishful thinking, but maybe it will happen. If this question is for the here and now then the answer is simple. No, an apology should not set anyone free, and if they did the crime and hurt someone, then they need to be incarcerated in a way it fits the crime.
Certainly not. Apologizing for violating someone's body and being the cause of the victim's trauma is ridiculous. That's not going to help and the apology isn't even sincere. A rapist is evil and that's all there is to it. If they say sorry and they know they'll get away with it, they will do it but then go violate someone else's body. the punishment should fit the crime. If those who were harmed offer forgiveness and acceptance and society is viewed as not being in danger, then ok. some amends should be made.
the point is there needs to be genuine understanding of what went wrong, acceptance of mistake not to repeat, corrective actions taken and amends made to those offended.
I can only guess govt is proposing this because prisons are full and so many crimes are being committed. We in society need to realize that we are devolving and need to take all actions possible to lower the trauma rate in society and train people so they have discipline, respect for others.

I have worked in the court system and watched a couple movies and I believe persons who rape someone either male or female should be punished because I have witness where rape victims become affected by the incident especially Kids who are marked for life and will have negative thoughts and behaviors and will take many years for victims to become normal and not affected by the incident
