A defendant is innocent until proven guilty, so he would not legally be prevented from declaring his candidacy.

@exitseven I hear what you're saying, but my mistrust of people leaves me uneasy about this whole thing. I say this because when President Trump moved out of the White House, he didn't personally pack the boxes that went to Mar-a-Lago with him. Who knows if people didn't plant incriminating evidence in those boxes? How do we know the FBI didn't set him up with planting papers when they raided his home? After all, the FBI cannot be trusted and that's a fact! I'm just waiting for the other shoe to drop. I mean, if the left pulled off unlawfully stealing the Presidential election, what more can they pull off? They are snake's in the grass 🐍

1. We won't get a trial within ninety days. The justice system simply doesn't move that fast.

Opinion Owner+1 ySure it is. Criminals always cry they’re being persecuted rather than accept responsibility. If there was nothing illegal found at his residence, he’d have nothing to worry about. It really is that simple.

So you have no problem with law enforcement going on a fishing expedition in your residence? Are you aware what the requirements are for a federal search warrant?
You couldn't possibly know whether Trump is actually guilty of anything. And it's not like federal law enforcement never lies or breaks laws, you know.

He obviously had classified and top secret documents in his possession pursuant to the probable cause established for the search warrant. The warrant was valid. In fact, the FBI tried for months to negotiate the return of these documents out of courtesy to an ex-president. It was only when they got no cooperation that they obtained a search warrant. Trump forced their hand. He shouldn’t be in possession of any of these documents. They belong to the people by federal law and not the president. They belong in the National Archives. His only saving grace here might be if he can show he declassified the sensitive materiel before leaving office. Since there’s a formal process for doing that, it should be easy to determine. Rather than crying about it because you like him, maybe keep an open mind. In the end, this could end up like the Hillary Clinton investigation where they cannot determine criminal intent. Regardless of the criminal outcome, classified and top secret information cannot remain unsecured in cardboard boxes at a golf resort no more than they could on a private server.

You are in absolutely no position to tell someone to keep an open mind, especially since you clearly don't have one yourself.
The warrant covered ALL documents from Trump's entire time in office. That is obviously an overly broad fishing expedition, which isn't legal. And what was the probable cause and reason for the warrant request?
You incorrectly stated that "the FBI was negotiating with Trump for months" over the documents and that Trump was not cooperating. That is not correct. The National Archives had been in communication with Trump, who had been cooperative. In fact, the site had been visited in June by DOJ employees who had looked around the room the documents were stored in, looked in the boxes themselves, and took some documents with them.
Why do you assume the documents were unsecured? Are you sure they were?
You admit that the documents may have been declassified after claiming he "obviously had classified documents", which is totally contradictory. Are you claiming that no former President is allowed to keep any declassified/unclassified documents, e. g., for their presidential library?
The Constitution guarantees rights regardless of whether someone is liked or not, and everyone should support ensuring these rights are not violated. You may call that "crying", but the violations of people's rights by the government is no laughing matter and occurs much too frequently.
So tell me, what would be the probable cause for searching your residence, since you have made it clear you wouldn't mind it being searched by the FBI?

Before the FBI invades your home, they must PROVE to a judge that ALL other legal avenues have been exausted or there is an immediate likelihood evidence will be destroyed. We know ALL legal avenues weren't even close to being exhausted. As far as an immediate danger of evidence being destroyed? We now know the warrant was signed an the fifth but wasn't executed until the eighth. I actually worked FBI, we do work weekends! I have no problem with Trump being investigated but what occurred Monday, crossed a line.

Jesus Christ! On June 3, investigators were given ALL subpoenaed documents. No other documents in Trump's possession were under subpoena at that time.

Opinion Owner, you have already acknowledged that it's possible that the documents taken from Mar a Lago had actually been declassified. Since that is the case, why do you falsely claim that the "search warrant proved that's a lie"? Are you saying you're a liar?
To show you why you shouldn't just parrot the government 's claims, Trump issued a memo on Jan. 19, 2021 that declassified all documents related to the illegal FBI spying on his 2016 campaign. Were these documents the ones that the FBI was actually after? - +1 y

And since the FBI is an arm of the Democratic Party, it’s much more likely they were looking for documents to help the Jan. 6 Kangaroo Committee and the other Democrat criminals targeting Trump. Trump has also sued Hillary over her Russia Hoax, which the FBI was involved in, so it’s very likely they were looking for documents related to that as well.
