South Carolina just legalized Murder for people 25 and under. Do you agree?

They literally passed a law making it impossible to prosecute anyone under 25 years old for murder. This is ridiculous. I knew what murder was when I was 4 years old and I knew it was wrong, so why shouldn't every other 4 years old be held accountable for murder?

No, no, no, and no. No legislature anywhere legalized murder for people 25 and under. That is just absurd.

Here's where the garble may come in. Maryland recently introduced HB1180, titled the Youth Accountability and Safety Act. The proposed legislation, if passed, would prohibit a person from being convicted of murder in the first degree if they are 1) under age 25 at the time of the offense and 2) committed the crime in the perpetration of or attempted perpetration of certain crimes.

The bill is aimed primarily at murders charged under the felony murder rule. If you don't know what that is, the simple explanation is if anyone is killed during the commission of a crime, the offender and any accomplices may also be tried and convicted of first degree murder. Intent, or lack of it, does not matter. For example, you and two of your buddies decide to break into a home and steal some goods. You wait in the car while your buddies mule kick the side door in and enter the home. They are confronted by one of the home's occupants, who shoots and kills both of your buddies. You are either apprehended or turn yourself. The homeowner is deemed justified in using lethal force against the home invaders, your two buddies are dead, which leaves you to be charged with two counts of felony murder in the first degree, along with burglary and other lesser included offenses. It doesn't matter what you or your friends intended to do (like break in while no one is home), the tab for your buddies' death is on you. Prosecutors may (and often do) reduce the charges to second degree murder to reduce your punitive exposure, but you're still going to pay for their deaths even though you weren't in the house and did not pull the trigger.

The bill, if it passes, doesn't "legalize" murder at all. It takes first degree off the table, but it does not prohibit second degree murder or manslaughter charges. Proponents argue that capping punitive exposure for young offenders increases the chance of successful rehabilitation. They can't do that if they're incarcerated for life.

There is no way they are going to legalize murder no matter what the age. ***If*** they did anything at all it's probably something like they can't be charged as adults or something like that.

1. Apparently, the law to which you refer comes from Maryland, not South Carolina.

2. The law - 2022 Maryland Senate Bill 850 - was a proposal which was filed on Feb 07, 2022 by Senator Chris West and was withdrawn from further consideraton by its sponsor on Feb 28, 2022:

3. That means that the proposal never even got any consideration from the Maryland Senate or House of Representatives, it was never adopted, it was never signed into law by the Maryland governor, and the existing law was never changed.

4. The bill, if passed, would have meant that a person under the age of 25 could not have been convicted of first-degree murder and would not have received a life sentence. Those defendants would have been convicted of second-degree murder and they would have received a penalty of up to 40 years in prison. It is a gross misrepresentation to claim that this law "legalizes" murder for perpetrators under the age of 25.

5. Obvously, this is a proposal that most people would condemn and it seems to represent an attempt to implement some woke agenda. Voters everywhere should stop voting in lock-step with their party and elect candidates who represent good values and good policies for the people.

6. You, sir, have contributed to the war of misinformation on the internet. It seems you horribly misunderstood, or recklessly misrepresented, one person's attempt to change the law, as if it was a done deal. There are users who will read your post, never read what I have written, and will come away thinking that South Carolina has legalzed murder by young people.
