I say yes, not because she should actually be convicted of it, but because it's a good tactic by the DA to get her to plea out on manslaughter, accessory and the burglary with a high sentence. The cops, DA, and judge aren't fools, they were going for aggravated burglary. If the homeowners' kid hadn't managed to kill them, they would have been dead, or disabled. It's not like there is a peaceful way for that to go down, even if you go with shock and awe, blow the back door open, kill everyone inside, grab the drugs and cash, run, well, it went well for your crew, but not them.
She planned an aggravated burglary, there's outrage, young men are dead, she's going to get the book thrown at her.

I'm more likely to use a shotgun point blank, easily maneuverable in a house and around corners, but really one could kill all 3 of the criminals with any gun, a 9 mil hand gun with 16 rounds could easily do it too. Using Hollow point ammo, is going to really mess them up.
Under conspiracy laws or something like that, when someone dies. All people are considered to be the same. I'm okay with that, I have zero sympathy for criminals and that dad is a asshole, trying to downplay it and thinking the fight should be 'fair' there is no fair between criminals and self defense.

The theory of felony murder is that there are some crimes which have such a high tendency to result in injury or death that such consequences should be foreseen. Two or more people agree to jointly perpetrate a crime and share in the proceeds if they are successful. There may be different roles in the perpetratio of the crime but they all participated in the planning and execution. Therefore, they are all responsible for the foreseeable consequences, including death.

I don’t see why the getaway driver is being charged with murder. That would mean she would have known her accomplices could have died.
And the shooter seemed like a Call of Duty military power on the 911 call. But he was defending his home. I can’t find any details on how the shots were fired. Did the shooter overkill?
There was a case several years ago where a couple of teens were breaking down a door. An old man who lived there waited silently aiming a gun. No calling out, no warning, just waited for them to break in before executing the kids. Don’t remember how that case ended.
But I think there should be a “Call our law” perhaps, and of course gun control that limits how freakin powerful rifles can be.
The driver is, at worst, only guilty of conspiracy to commit burglary. To bloviate otherwise is a miscarriage of justice. The driver killed no one. Still... being stuck in prison as a failed getaway driver can't be good for one's social standing amongst inmates.
The driver is an accessory to the fact (of the crime). They're just as guilty as if they actually committed the crime itself. I totally agree to charge the surviving thug with the full extent of the law.

I am not understanding your point. But I don't think the grandfather cares that much about the choice of weapon. He is grieving over the death of his grandson. So he is excusing his behavior and trying to invalidate the law surrounding his death.

For home defense, I prefer a semi-auto handgun as opposed to a rifle.
