Thoughts on NY subway death? Murder, negligence, accident?

Victim was homeless, screaming at people and tossing trash. He may have made physical contact but obviously nothing of note. But still could be self-defense. The “killer” did use a chokehold.. which it’s in the name. Seemed like negligence at least to me.

You don't choke hold someone in self defense. The point of self defense is to injure someone so you can get away from them.

Poke eyes, dislocate knee caps, bite, scratch, punch, kick.

I feel like putting someone in a chokehold is unnecessary, plus the position you would have to be in to get someone in that position would make you also in an advantage to run away.

Now I'm not sure what the whole situation was so I don't know if this person was doing it to protect someone else. If that's the case I'm not sure.

Agreed. I have some training from working with mentally disabled adults who sometimes get rough. We have to disable their movement whilst not restricting airways. A choke hold by definition was first to be taught against.

But this homeless guy, from my reading, was acting crazy. Just devils advocate.

From what I read just now he wasn't physically harming anyone he was being a nuisance and harassing people which isn't okay but doesn't call for a chokehold.

Yes, you do people in the military use chokehold all the time the idea is to put pressure on your arteries so that you can pass out. A stranglehold is when you put pressure on the trachea, which damages the trachea which is lethal

@msc545 I don’t know. Sounds situational. I was in Dallas during the sniper attack on police. I wasn’t on the subway during this incident. But it sounds like in this case it was, as the chokehold guy is charged with homicde.

This was clearly self-defense. I don’t know when we decided that you had to get physically assaulted before you were allowed to defend yourself this guy, Jorden you can’t remember his last name was threatening passenger saying he wants food. He said he didn’t care if he went to jail or he died or he hurt somebody was he supposed to hurt somebody before someone stepped in? Why wasn’t this guy in prison this guy had 44 prior arrests and was very clearly mentally ill. You should not have been on the street. He should’ve been in prison or in an insane asylum but we don’t have insane asylums anymore so the only option for this guy is to be in prison. I don’t know when it became a thing where you have to get hurt or you’re allowed to hurt a person back. If this man was swinging everywhere, you would be saying something completely different.

Are you supposed to wait until he actually hurt somebody or are you supposed to take them out? If the former why do I have to wait until I get punched in the face to hit back?
