Anonymous(30-35)+1 yThere is no one size fits all penalty for rape, because the term rape is used to describe so many different things now. For example, a man and woman meet at a bar, go to his place and have sex. Both have been drinking, but legally she could acuse him of rape because she was too drunk to consent, even though he was drunk too. Many men have been convicted of rape in that scenario. Does they deserve the same punishment as a man who violently attacks a woman and forcebly rapes her? Definitely not.
There is also the issue of false rape accusations. Despite the common misconception, it happens frequently. But most of those cases never make it into the statistics because the charges are dropped due to lack of evidence before the case ever makes it to the courts. But some of them do, and many men have been falsely convicted of rape, either due to a false accusation or mistaken identity. Mandatory harsh sentences for rape would be very harmful to many men.
The legal system is imperfect, but the way rape is managed today is about as good as it's going to get. Rape should be handled and sentenced on a case by case basis.

Now if the victim is 18+ I’d let the victim decide his fate.
If she said death. So be it. If she wanted chemical castration so be it. If she wanted true revenge and wanted to cut off his penis - so be it and they would have a medical team standing by to stitch him up so no blood loss. Or if she wanted total nullification (penis and testicles removed) same procedure as above. Or if she wanted prison justice. But it would be all up to her. However if she couldn’t handle that kind of decision making power - then the assailant would have to choose between the options given. But it shouldn’t be prison - prisons are already overwhelmed and they take forever to execute someone.02 Reply

+1 yit's a hard one... say you were raped on a subway platform different than a date rape... i'd say 1 year for any rape proven... then higher as more rapes occur by the same individual... or just simply castrate a man who rapes... or remove his penis surgically... or give him a mandatory sex change operation.

Drunken: If the victim was blackout drunk, I would classify that s forcible so see above. If both were slightly tipsy adults who seemingly "consented?" If I were a DA I would likely decline to file.
Statutory: depends upon the specifics. I see a world of difference between a 40 year old who messes with a "willing" pre-pubescent and an 18 year old who messes with a 17 year old who lies about his/her age in a jurisdiction, like California, that has no close in age exceptions.11 Reply- +1 y

+1 yfirst it has to be checked that she is not lying, like Amber Heard or so, secondly I think the gravity of the rape has to be checked and punish accordingly like:
-drugged and taken advantage off and her npt being consciously aware of whats happening -> 5-10 years
-tied up/immobilized and fully conscious raped -> 10-15 years
-tied up/immobilized and fully conscious raped and tortured/beaten -> 15-20 years
-raped by multiple people with torture/beating -> 25 to life
-idem with lifelong physical disabilty -> life
-captured and raped & tortured multiple times for a prolonged period of time -> life
-idem with lifelong physical disabilty or murder -> death sentence

+1 yI'd treat it like other violent assaults, and like those there is a scale of the severity of the crime.
This is not trying to minimize how bad rape is, but I think many people don't realize how serious the consequences of other violence are. A girl I know was attacked (non sexually) and ended up unable to walk correctly for the rest of her life (pelvis shattered in multiple places). People suffer brain damage and crippling injuries from assaults.

For certain kinds of first time rapes, prison time of 5 to 20 years, depending on the circumstances and severity. For heinous rapes, I could go for grabbing his dick and balls and slicing them off with a knife, then throwing him in prison for life. Evidence is not proof. There was a lot of evidence that Sirius Black killed 12 Muggles and Peter Pettigrew, but Sirius was innocent. Same goes for George Stinney, who innocently got electrocuted for ‘murdering several girls.’

@HippieVeganJewslim what was the evidance in those cases? Cause when I say evidance im not talking about witness Im talking about DNA. Like for example when you find a grown mans sperm in a toddlers underwear that is evidance. It happens here in Sweden a lot but we dont sentence them at all and if we do they can't get more than 1 year

Drunk sex as rape leaves way too much room for honest mistakes) that actively gets off to having sex knowing that consent was not given, even still I'd say life in prison.
