An employer and employee can agree to just about anything they want. It shouldn't be required by law though. The only thing that should be required by law is that hourly employees be paid for the actual hours they work.

Why should an employer be required to pay a woman for 12 weeks of leave every time she decides to get pregnant? Why is her financial support the employer's responsibility?
Sure why the hell not. People get maternity leave. Even the father gets maternity leave. My wife got nothing when we had our kids. My boss gave me shit because i wanted the day off to witness the birth of my son never mind getting maternity leave.

Only if that was in the employment agreement. Otherwise, companies must make a profit. They cannot afford to pay for not working.
