    Does Palestine have a legal claim to Israeli land?


    Neither a country nor a state of Palestine has ever existed but it refuses to go away from the current news cycles.

    The Kingdom of Judah, the land of the Jews. was formed and named after Judah, the fourth son of Jacob and Leah, about 3 millennia ago or so. The Kingdom of Judah lasted for about 350 years, until it was conquered by the Babylonians in 586 BC. The Babylonians destroyed the city of Jerusalem and exiled the Jewish people to Babylon. The Jewish people eventually returned to their homeland, and rebuilt Judea. Following their return, the Jews of Judea were variously ruled by themselves, the Persians, the Greeks, and themselves again.

    In 63 B. C., Judea was conquered by Rome. Judea was initially ruled as a client kingdom, but was later made a Roman province. Roman rule in Judea was marked by conflict between the Jewish people and Rome. In 66 A. D., the Jewish people revolted against Roman rule. The revolt lasted for seven years and ended with the Romans destroying the Second Temple in Jerusalem.

    The name Judea was changed by the Romans to Syria Palaestina by the Roman emperor Hadrian in 135, following a Jewish uprising against Roman rule, that was crushed by Hadrian. Hundreds of thousands of Jews were slaughtered. To suppress Jewish identity, Hadrian renamed the province Palaestina; derived from the Philistines, a people who had lived in the region centuries earlier.

    The The name Syria was added and intended to emphasize the region's province’s status as a Roman province. Renaming Judea was an attempt to "cancel" the Jewish nature and history of the land and to humiliate the rebellious Jews; a reminder of the Roman Empire’s power. The name Syria Palaestina remained in use until the 7th century AD, when the region was conquered by the Arabs.

    Arabs ruled until the Crusaders took land back; then lost it to the Arabs, who then lost it to the Ottoman Turks in 1517. Due to the loss of WW-1, the Ottomans gave control of the region known as Palestine to the British in 1917, who ruled it until 1920 when Britain was officially granted control of the the Palestine region by the San Remo Conference. The British Mandate for Palestine then governed the region from 1920 until 1948.

    Between the defeat of the Ottoman Turks in 1917 and the British Mandate in 1920, the Palestine region was under British military occupation. It did not constitute a formal state entity. The preamble of the mandate’s text stated that Britain was responsible for putting into effect the 1917 Balfour Declaration in Palestine, which declared Britain’s support for the establishment of a national home for the Jewish people in Palestine, without prejudicing the civil or religious rights of the existing non-Jewish communities.

    The San Remo resolution stated that Britain would be responsible for enacting the Balfour Declaration and facilitating Jewish immigration and settlement within the Palestine region. The resolution restricted the sale of state lands to the Jewish people, meaning that the Jewish national homeland would be formed through purchased settlement on private lands.

    The San Remo resolution called for facilitating Jewish immigration under suitable conditions while ensuring the rights of all inhabitants were not prejudiced. The resolutions required Britain to facilitate the creation of a Jewish national home in Mandatory Palestine per the policies of the Balfour Declaration.

    There never was a Palestinian state, country or sovereign people. There never was rule by any government called Palestinian. The land of Mandatory Palestine was to be the Jewish national homeland in an area occupied continuously by Jews for millennia. Jewish rule and occupancy antedated the emergence of Islam by millennia. Mandatory Palestine, set aside for the National Homeland of the Jews. Its territory was diminished by around seven eighths, in violation of British mandatory obligations to create Transjordan, now called Jordan.

    No state, nation or people called Palestine and Palestinians ever existed. Hence, the Palestinians never existed do not exist except by their own declaration. That's It. The concept of a separate Palestinian state and people was created as a means for continuing the struggle against the state of Israel. There is no difference between Jordanians, Palestinians, Syrians and Lebanese. Only for political and tactical reasons do they speak today about the existence of a Palestinian people. Arab national interests demand that they advance the existence of a distinct Palestinian people to oppose Jewish Zionism.

    A separate Palestinian identity exists only for tactical reasons. Jordan, a sovereign state with defined borders, cannot raise claims to Haifa and Jaffa, while "Palestinians" do, along with Beer-Sheba and Jerusalem, and yet they have no interest in uniting "Palestine" and Jordan. And recent news items say that Jordan would not accept them.

    So, regardless of anti-Semitic "Feelz", the answer is NO. Nazi Germany didn't have rights against the Jews, either.

      Abraham was the original jew. He was from mesopotamia, or what is now known as Iraq. Jewish people didn't end up in what is now Israel until the exodus because they were supposedly told it was their birthright by god. The promised land, as it were. When they got there, it wasn't unoccupied. People already lived there. The jewish people drove them out to what is now Lebanon. Lebanese people share more DNA with Palestinians than the majority of jewish people who currently occupy the country. Just saying.

    Nope. Jews bought land from individuals under the Ottoman Empire, and then later from individuals and the government under the British Empire. The British government was lobbied by the Rothchilds who used their financial influence and prestige to persuade the British government and United Nations to grant them a favorable deal when the territory was split. The Palestinians didn’t like the outcome of that split, so they started a war with Israel who had declared independence. Israel won the war and as a result, the Palestinians ceded territory for a temporary peace treaty. This lead to more wars that were started and lost by Palestinians which lead to more territory being lost in negotiations for peace. That’s what happens in war.


    In the Spanish-American War the United States backed the Cuban and Filipino revolutionaries and went to war with Spain. We won the war and the Spanish Empire took a major hit and had to cede Cuba, Puerto Rico, Guam, and the Philippine Islands to the United States in the 1898 Treaty of Paris. Did we steal the land? Does Puerto Rico need to be freed? No. Sometimes people within a land are subject to higher powers that make decisions that effect them for better or worse. If they take up arms they can always fight a war of independence, but they always have to win the war to gain the territory. Whoever can hold the land at the end of the day owns it. Someone will eventually give when too much blood and treasure has been lost.

      Borders constantly shift. Nations rise and fall. No one has rights to any land. Nations and individuals for that matter just hold onto portions of land for as long as they can afford to do so.

      @Jumpintoadstool After a handful of land exchanges you'd be forced to be a feudal serf and some aristocratic would come to your home, kick in your door with like 20 men, stab your lover in the stomach with a sharp bade, take all your food stores, rape you, conscript your children into the army to go die on some field of battle with a neighboring kingdom and leave you on the floor sullied then demand you clean up the guts and address them by their title properly, and have the next harvest ready in two weeks when they return.

      But let Israel strike back in Gaze where HAMAS IS, that is just evil above all evil. How dare they attack the terrorist who murdered their people.

      Hamas, they are like the Nazis. Some German civilians were hurt while the Nazis were being destroyed. Sad, but unavoidable. The Nazis had to be wiped out.
      That was priority one for the world. All the peace, help, food donations, money to rebuild, supplies to rebuild, reparations... that came AFTER the Nazis were wiped out and there was peace.

      Hamas has to be destroyed. Non-negotiable.
      Peace will come after they are gone. The rebuild of Gaza will come after there is no more Hamas.

    This slip of land has gone back and forth between Arabs and Jews for thousands of years. And others have laid claim to it too! The Brits held it for a minute. It's always been a hot potato! Everybody wants it, people have fought over it. Win, lose, draw.

    I can't make heads nor tails of it. What I do think should happen is that Palestinians and Jews have to come to peace terms and shared citizenship. This will take hard bargaining and advocates working on both sides and compromise.

    Don't know if I'll see it. But this instability and fighting ruins it for EVERYONE. People want to have good lives. Doesn't matter about anything else. Fairness and giving will lead to peace. Israel will have to give. And Palestinians will have to give up on terrorist organizations as representatives.

    Stability and peace will serve the entire world and lead to nothing but good.

      @Screenwriter Why does anyone want Israel which is only 9 miles wide at its greatest to begin with? Are they afraid of little ole it? When both Egypt and Syria attacked Israel on Yom Kippur, a religious holiday, Israel was caught flat footed and came close to losing but they still managed to kick both Egypt and Syria's butts. They kicked bum fuck Egypt and Syria twice in wars. So Israel are not the bad guys, they are just sick of other countries trying to kill them.

      This is land that's been fought over for literal millennia: the Crusades, Christians, The Arabs, the Jews, it's the Holy Land for Islam and Jews AND Christians. Someone told me it's a beautiful place. But strategially, it is in the center of the Middle East. So, it's terribly important because of that. It's the only country that US and Britain have relations with and financially support. So if angry Islam wants to mess with us, we have a foothold in the area. That's why it's REALLY important to us. To Islamic people, its a religious thing and they've always been there, just like the Jews have. It's just changed hands a dozen or so times through the past 3000 years.

    If you say legal claim, yes, but jewish people make religious claim, not legal claim. And it doesn't make any sense.

    1. There is no proof to show that the modern day Jews are the descendants of the people who lived in Palestine 3000 years ago.

    2. Even if they are the descendants there are 2 issues.

    Issue 1: Before the supposed ancestors of modern Jews ruled the land 3k years ago, there were already native people from various tribes living in the land. Then those natives have better claim over the land by this logic.

    Issue 2: Just because someone's ancestors ruled a particular place centuries ago does not establish claim now. Greek king Alexander ruled Egypt. Does not mean Greeks can claim Egypt now. The British Empire ruled much of the world, incl. America. That does not give the British the right to take over America. Same way, Muslims ruled Spain, India, etc., that does not mean we have rights to these lands now.

    Yes. Israel shouldn't exist, frankly. Britain had no business giving away land that was not theirs in the first place. Not to mention the inhumane way they forced people out of their homes at gunpoint during the nakba. The point was never to assimilate, it was always colonization and ethnic cleansing.     Not at all. The Jews haven't yet been given back all the land that belongs to them which was stolen by the "palestinians" and other nations in the region ever since the Second Diaspora.

    Since the Palestinians like Iran so much, maybe they should move to Iran, and get the hell out of Israels' ancestral lands.

    Even if they don't have a legal claim that does not justify genocide. The Israelis take over Palestinian land by moving settlers onto the land and reacting violently when the Palestinians object. I don't see this happening to the Israelis in reverse. The Israelis are war criminals and in many ways no better than the Nazis were.

      Living first you saying then the Palestine belongs to Muslims... if you study the history of BANI ISRAEL then you'll get it... people who are atheist or are not connected to any Religion can't understand that it's a fight because of religion... the place itself is very Sacred for both of them... but it belongs to Muslims... if you only go in depth of it...& You saying it's Soo small in another comment why they are not leaving it... cause it's in centre of Arab Countries...& Jews want manipulation... nothing else...
