Can someone tell me why illegals don't face prison for child rape and just get deported?

Elmer Sola, a 49-year-old illegal alien from El Salvador, crossed the United States-Mexico border on an unknown date at an unknown time.

Sola is one of the millions of so-called “got-aways” living in American communities who breached the border without being detected by Border Patrol agents.

Under President Joe Biden and Vice President Kamala Harris alone, at least two million got-aways are estimated to have arrived in the United States via the border.

In August, Sola was arrested on the island of Nantucket and charged with three counts of aggravated child rape and eight counts of indecent assault and battery on a child under 14 years old.

This month, Immigration and Customs Enforcement (ICE) agents arrested Sola. He remains in ICE custody pending deportation from the U. S.

“Elmer Sola unlawfully entered the United States, then made his way into our Nantucket community before allegedly committing some horrific and despicable crimes against a child,” ICE official Todd Lyons said in a statement. “The officers of ERO Boston will not tolerate such a threat to the children of our New England neighborhoods.”

In my country we had illegals commit serious crimes like child rape. They were duly tried and imprisoned on conviction. The real problem happened after they had served their sentence.

Obviously they couldn't be trusted to not re-offend and why should the rest of us take any chance with children when he was an illegal and shouldn't be in our country? So this guy was detained pending deportation. That was OK.

Sadly our highest court (the High Court) decided that if there was no prospect of deporting an illegal immigrant. The reason why he couldn't be deported is that he wouldn't fill his countries forms so he could go back. So it was a stand off and regrettably he won in the High Court and there was order for him to be released from detention.

Our out of touch Leftist gov't took the opportunity to release all illegals who had served their sentence and were in detention waiting deportation.

The first thing one child rapist did on release was to ask a child for sex!!!

Woke courts are pitiful and more for illegals than citizens. If they won't sign the forms they should rot & die in detention.

I see you dont understand how citizenship works.

If they are an illegal immigrant, then that means they are a citizen of another country. That means that your government technically does not have jurisdiction over them and does not have the right to put them in prison. Of course its more complicated than that, and most countries give consent to imprison each others citizens under certain circumstances but that brings me to the 2nd problem.

Why would you want to? Imprisoning someone takes up valuable resources, both in costs and in things like wasting the time of the legal system that could be used to serve citizens. The cost of a prisoner per year in USA can be several hundreds of thousands a year. And for what? Best just to buy them a plane ticket and kick them out.

Unless the individual has full diplomatic immunity they are subject to the same laws as a citizen while they are in the country. Any country.

What most civilised countries do is to try the person under the national laws of the country where the offense occurred, denying bail, and if found guilty they are sentenced accordingly.

Unless there are no diplomatic relations between the two nations, the host country then arranges the deportation and imprisonment in the offender's home country. What they do with a criminal after they get them back is that country's decision - although for more serious crimes they tend to not just let them out in the city centre with cab fare. The alternative would be diplomatic sanctions that could potentially cripple the economy of a developing country.

The only exception is in a capital crime where a death sentence has been handed down.

Lets just use a few examples. There was recently a major prisoner swap between USA and Russia. While there is a lot to comment regarding the people involved and the situation, why do you think both sides demanded their citizens to be released from custody? They were convicted in a court of law, they are legally guilty of a crime and had a sentence to serve. It is almost like both countries objected to each other having the right to hold their citizen captive...

@DJB72 Furthermore, upon being swapped both were let go for different reasons but the sentence was not recognized in a legal capacity. The legal jurisdiction of one country is not automatically respected in another. People tend to forget that since we live in a globalist society where every country has a spiderweb of agreements with each other to facilitate cooperation in any number of ways, including judicial.

It gets more complicated however. To nations the citizenship is important even if they dont want the person. Having a citizen serve a sentence ruled by another country inside that country is an infringement of their authority, even if it is between "friends". The stronger the nation the more they can get away with but there is always a cost. Every prisoner each nation has of the other strains the relationship and comes at a diplomatic cost which is stupid to pay just for the privilege of putting bad men in golden cages.

Of course, the story does not usually end at deportation either, especially if the countries are friendly with each other then they tend to take over sentencing the individual either by honoring the judgement from the first country or by holding their own court case. Suffice to say that its unlikely for Elmer Sola to just walk free after being deported by that is besides the point and is not why USA deported them in the first place.

You clearly do not get it. A citizenship is many things, for example it is protection. That means that your country has the obligation to protect you from other countries. As such, if one country (such as the USA) convicts and imprisons a citizen from another country (AKA illegal) then that other country has an obligation to recover their citizen from USAs jail, by force if necessary. Wars has been started over this, countries takes citizenship that serious.

To reiterate: if you're convicted of a crime in a country you are not a citizen of and you DON'T have diplomatic immunity then you're at the mercy of that country's judiciary. The State Department sent multiple representatives to the country - Thailand I think - but failed to secure a commuting of the sentence. Not even a presidential call asking for leniency helped.

If you don't believe me, try taking two Bibles into Saudi Arabia or Indonesia. You'll be arrested and - best case - deported. Under islamic law you can be beheaded for this "crime". Being American (or any Western citizen) won't help you.

They are not trying to enter the country illegally in the first place, they are trying to process their asylum claims and to do that they first need to enter the country by any means necessary. Yes, that means that they have the legal right to use any means necessary to enter any country for the purposes of Asylum, even if those methods are illegal. This right is guaranteed by the UN and signed by both USA and the UK so no use whining about it now.

But yes, the fact that they are asylum seekers is important because they are not trying to hide themselves, like they do in USA. As such there are no "boats" in USA, the illegal immigrants enter the country through other means such as legally enter and overstaying Visas or through people smuggling. None of which can be stopped by building walls or whatever since they enter through legal ports of entry.

Lets rephrase it in a way that even you can probably understand. A citizen is kind of like the property of a nation. Sure, they can travel around to different countries or even illegally enter but they are still "owned" by their parent country. If your country imprisons them or hurt them in any way then that gives their country the moral right to retaliate as well as the obligation to do so.

It is no longer them that raped or murdered a citizen of your country, things like that does not matter in international diplomacy. Rather it is your COUNTRY that has harmed the citizen of another COUNTRY. The fact that it is an official national act makes all the difference.

We passed a law in Louisiana to massively extend sentences for child molesters, and allow surgical castration to be a sentence for those who are repeat offenders for those under 12 years old.
