Whenever you need to apply for asylum in the USA or Eritrea.

The USA and Eritrea are the ONLY two countries in the world where you need to be on their soil to apply for asylum. Hence there is no such thing as "cross the border illegally" in both countries, and only a court of law can decide that - after your asylum is rejected.

What it's more useful to me is a general sense of fairness, if possible. Such as: "could this person have avoided this situation if they cared to?"

That's why laws that are passed don't criminalize behavior that was done before the law was passed, because you cannot conceivably prepare for that.
