Under Article II, Section 1, Clause 1: All executive power is vested only in a single person—the President of the United States, plus provisions on how he does that. The Sitting President has absolute immunity from liability for official acts. Article II does provide that the President Takes Care that the Laws be faithfully executed but It does not limit the President's discretion in how and when to do that. The Law is the Law, not any unenforceable court opinion of it.

Article II does not subject the President to any court ruling, even by SCOTUS nor provide any avenue for enforcement. The Supreme and any other Court can rule on the Constitutionality or legality of an Executive Action. DJT may, may not comply or appeal any ruling, Even then, the courts have no power to enforce such rulings. In the end, the President will just have to say: NO! Then there are only three recourses against The Executive. Impeachment, the 25th Amendment an assassination. Full Stop.

That is not true at all. While the president has broad power over foreign affairs, Article I, Section 8 of the U. S. Constitution vests the power to lay and collect tariffs with Congress.

While Congress has historically given the president limited control over THEIR power to control tariffs, this very obviously exceeds that responsibility and falls back to Congress.

The National Emergency Act is not the constitution. The law that congress controls tariffs IS in the constitution. Furthermore the National Emergency act was written in 1976 and the court system is actively ruling that it does not apply here.

In Trump's mind that's probably all the countries so he just gave every foreign company a really good reason not to invest in building a factory in the US.
