The whole legal system is a bunch of "it depends." Don't get me wrong there's a lot going on but fundamentally law is more culture then a hard biological science.

Hardest pill to swallow is majority of rapist have been raped as a child. This rope noose of minimal punishment is a large barrier to ask for help. From there a tool for rapist to exploit victims as it's more common for family and friends tend to relationship between rapist and victim. "I help you learn to ride a bike." Manipulations.

Ultimately what I'm saying this line of discussion does more harm then good. Focus on helping victims build up safety nets and proper connections with healthy boundaries. The rapist loses all power and goes away.

My biggest concern is finding a rapist and turning it into a blood sport. From there the rapist already consolidating all power have more control. Same reason why the epstein files are not being shown.

There is a reason justice is blindfolded with a sword and scale. It's hard to take a step back but that is exactly what justice needs and it's better on the long run.

More prison time won't get rid of rapists either but what it does do is keep them out the public which is mostly all that can be done. Nothing is going to get rid of bad actors and certainly not less punishment for their actions.
There is a reason why repeated offences are higher with shorter sentences, and why kids will do something bad again if they aren't held accountable.

I'm just saying focusing on the victims and ability to ask for help. You are hurt getting hurt? Ask for help.

We need to consider the situation surrounding the rape. You had sex and she was drunk but made no indication she was unwilling. Technically, she was raped because intoxication means you can't consent, but she wasn't actually indicating unwillingness. Likewise, if you are near the same age (1-2 years) and dating, without the Romeo and Juliet law, it's statutory if you are of age and the other person isn't. That shouldn't land you in jail for 10 years. So, it has to be on a case-by-case basis. Large age gap statutory rape (yes) and violent rape (yes). With other rapes, we need to look at the specific circumstances.

Sleep with drunk girl who claims you raped her which is a factual statement since that is rape then 10 years at least makes total sense. Maybe next time don't sleep with a drunk girl who can't consent or someone you trust who isn't going to claim that afterwards.

As to the other just make Romeo Juliet law standard it's a common sense law anyway, then we don't have to include that.

As for Romeo and Juliet laws, I agree that they should be national, but they aren't, so again, until there are changes, we can't say 10 years.

I'm saying in the case that both parties are drunk, the guy is never seen by law as to be unable to consent. The law is unfair that only girls that are drunk can claim intoxication as a reason they couldn't consent. I'm not saying that the guy should claim rape, but just like statutory rape doesn't happen when both participants are underage, rape when both parties are intoxicated should also not happen.
