Do you think the police should have the power to evict tenants who do not pay?

Tenants will be given a week chance for example if they do not pay and still refuse to leave then the police will come in and drag them out by force if necessary. Easy and quick.

Currently I just found out that in many jurisdictions the police have no power to evict tenants, and if you try to evict tenants who are not paying the police will proceed against you instead. It is this ridiculous. Never mind that there are other tenants ready to take their place and pay rent, and never mind that it is your property.

This matter is considered civil I read, and so the police can't do anything. But how is this matter civil and not criminal? When you take something without paying for it it is theft. It is theft whether the thing you take is a good or a service. Also from a different point of you, tenants who do not pay the rent are denying the owner the use and enjoyment of his own property!!! How much more ridiculous can you be?

Is this so that lawyers have a steady supply of complaints and income?

Absolutely they should but there's hot to be balance and common sense in the law.

I had trouble evicting a few families that wasn't paying, they were trashing the place. Eventually I got them out through thousands in court fees. Police refused to do nothing for one until I said they were doing crack, got them out that day. Another I paid a couple of guys to do something. Cost about 20& 30 thousand to fix each house up for renting again and that was me doing most of the work. I've never rented to black folks since.

My fault for renting to them. I learned better to leave a property vacant than to rent it to just anyone.

Lawyer told me there was no real point. Can't get blood from a stone and to be perfectly honest Id paid enough in legal fees. No point jointing with windmills. At the end of the day this is a buisness im running, granted its a side buisness

Something is really wrong. You can't damage another man's property, and he owes you for occupying the place and losing you revenue. There is a point, at least you have the satisfaction of ruining those animals you had a problem with. I dont understand why they can't just flag him with the money he owes you so that whatever work he does he has to give you a portion of his income automatically until he pays all the damages. This just goes to show that the justice system has not justice at its heart to restore everything his due. Or they will claim that you can seek payment for damages, but they make it so difficult that you think to yourself it is not worth it. It is a hell of a world that we live in. Scum ignorant, and criminal people wrecking havoc from below, and people in power who do not care. Like being squeezed in a vice.

By the way it is interesting what the lawyer told you. You said that the lawyer told you that you cannot get blood from a stone! Which makes me think so they are after blood like sharks these lawyers. If they know that you have nothing they will let you go even if you did wrong, BUT if they do smell blood than even if you did nothing wrong they will try to find some pretext to get money out of you. Again reaffirming the hell of a world we live in. Maybe not everything is so black, but this form of injustice of people trying to take money from you for no real justified reason is all too prevalent. Lawyers, women, the government, doctors (especially the USA from what I hear) almost everyone.

They aren't wrong. A lawyer will pursue almost any case you want because you are paying them. Its often just a matter of cutting your loses as you can go bankrupt pursuing legal cases.
Think about this, someone can take you to court for almost any reason no matter how stupid and even if you win or get it dismissed you still have to pay legal costs.

This is another damn point which boils my blood out of my pores. How on fucken Earth is it just that you have to incur legal fees in the case were you have won the case? It should be automatic and obvious that the other party have to pay your legal costs as well. Don't you think?
Why they dont make it work like this? I dont get it. The lawyers will still get paid. The issue is who should pay. Perhaps they aregue that you don't have to employ a lawyer? Well in principle maybe yes I dont know, that you are allowed to represent your self in court. But what are your chances to navigate the legal terrain so to speak on your own. They should be reasonable and practical and keep in mind that but for the fact that you did not have to defend yourself from the plaintiff you would not have had to incur any legal costs whatsoever. So in the case were the court dismisses the case, or finds you not at fault the plaintiff should pay your legal fees. Otherwise you open the possibility for people in power who have money to ruin innocent people that have the misfortune to come under their aim for no justified reason. Just to be vindictive. And then you end up murdering the plaintiff along with his family for revenge and you end in prison anyways. Because I do not imagine that I will accept that some mother f... fucks me out of say 10 or 20 thousand dollars in legal fees for nothing. What do you think on the main point I am talking about here?

It's complicated. Sometimes people are in a bad situation temporarily and they just need some time to get back on their feet. Job loss. A death in the family. Or sometimes they can be professional squatters.

Work with people who are trying to do the right thing. Drag the squatters out and shoot them on the front lawn.

haha yeah yeah in such extreme cases of death or something similar a month or two of delayed payment is granted if the owner can afford. But mostly it is the squatters which I had in mind.

I think any tenant should be given a 30 day legal notice to vacate. That gives them time to prepare to move out or to appeal to an assigned arbitrator. Although someone can appeal an arbitrator's decision in court, the likelihood that a judge or jury will uphold the arbitrators decision is very likely. These are hard times we live in, But specifying an arbitrator shows compassion.

Compassion should also be shown to who is being denied the rightful enjoyment of his property. But more to the point compassion should not be at the expense of someone else. If a judge wants to show compassion perhaps he can take the tenats in his own home! lol

Most counties the police do not do evictions since it takes special training to carry out court ordered evictions. Special rules on time and means of notification are required. In Texas when an eviction is granted the tenant has 5 days to vacate. After 5 days the owner can obtain a writ and the tenants belongings are placed on the curb. It is a court order

Excuses! It takes no special training to drag people out of a house they are occupying illegally. You just drag them out IF they resist. No of course this is what I am talking about, if they wrote the law like they did it is they who are making it complicated. In my opinion just so that they have a steady supply of income through court cases. How else can so many lawyers afford such an affluent lifestyle.
All it take is to switch this issue of tenants not paying rent from civil to criminal, and the police will handle it with ease in my opinion. All which needs to be done is to show proof of payment to know if they can be evicted or not.

@foxsquirrell Before you comment educate yourself. Go sit in eviction court. The landlords have a right to be paid for their property use. There are very specific rules and timelines for a lawful eviction. If the landlord does not follow the law exactly they do not get a judgement. Police cannot evict a person, only Constables and trained Sheriffs Deputies can do an eviction and only by a court order.

You said nothing in essence that I am not aware of. So before you advice people to go educate themselves make sure you have read and understood what they are talking about.
You are one of those people who come to this world to complicate matters and create problems instead of the other way round. The rules currently in place is EXACTLY what I am talking about and that is why I posed my question. WE made these rules and WE CAN CAHNGE THEM if we want to. Now if you disagree and think that the rules are ok that is a different story. Vote no in the poll. But I am saying that the rules as they are to evict someone who is not paying are unjust and should be changed. It should be made a criminal act to occupy a property without paying and so it becomes a police issue automatically without the need of lengthy court proceedings. They will simply drag the tenants out and arrest them if they resist getting out of the property when the police tells them to. Again if you disagree with this just say that you like the laws as they are. AT the end of the day it is a matter of opinion. The LAW is based on OPINION. Keep that in mind as well.
