Judges do not prosecute crimes. In Florida, those decisions are made by State Attorneys. In most areas, that position is called District Attorney. The judge presides at the trial, but the jury decides whether the defendant is guilty or not guilty. If the defendant is guilty, the judge then imposes a sentence.

A judge can dismiss a case if there is insufficient evidence upon which a jury could convict. That does not happen often, but it happens more commonly in trials of public figures, as those cases often involve motives unrelated to the enforcement of criminal laws.

Assuming a compelling case has been brought forward and the judge decides to show leniency despite the evidence and call off the trial then yes absolutely.


But sometimes it’s not even the judges, you have DA offices that refuse to prosecute because it would weaken their political position in the community

Judges don't prosecute, that's the job of the prosecution service (or your equivalent). Judges are there to hear cases and make sure both sides comply with legal proceedings.

If a judge refuses to hold trial its because one side has failed in their legal obligations. But they should reschedule the date.

I don't know details of the cases you're referring to but it sounds like the prosecution team are to blame for not doing their job rather than the judge.

Judges have little to do with it. They only work off the evidence presented to them.

In order to move against a judge you would be required to prove that they did not act within the evidence presented.

No, of course not. And that was actually in force which it will never be. Nobody would be a judge and sentences would be unreasonably harsh if there were any judges.
