Should women who commit paternity fraud be prosecuted?

Paternity Fraud is the crime that occurs when a woman names one man as the father of her child when, in reality, it is another man, and she knows that. Most women do this primarily to collect more money from the wealthier man. If the woman is successful, she has defrauded the man, who has to pay her. The man who is the real father, and who has to pay her and the child are the three victims in this crime.

100%, they should have to repay every penny acquired fraudulently, with interest and go to jail when she fails. She should also lose custody of her child (ren) and be ordered to pay child support to the father or whomever receives custody.
My unpopular opinion is that women guilty of any and all family crimes should be surgically sterilized. It’s revolting that western women are considered to have the “right” to literally create victims for their crimes. It rings more than a bit like one of the worst parts chattel slavery, but nobody seems to want to acknowledge that.

This is pretty much why we have DNA testing. The results of that kind of testing turn out to be extremely useful in identifying paternity fraud.

Without giving it much thought. . . You would need to prove that the girl never told him that he might not be the father. That will be a swearing match between him and her.

I think you would also have to prove that the girl didn't tell him only after he had been charged god knows how much in child support, but in fact had told him before that.

In lawful society this should be the case but our societies don't want any responsibility and you will find always a judge who will see that rights of the child and mother for child support stand above the right of the man who has to pay it. The reason, it reduces social benefits cost in case real biological father is unknown or too poor, because single mothers without father for her children will be always a burden for a society.

If the woman is not married to the partner, this could be a crime. But any child conceived in a marriage is considered the married partner's child. Now laws may have been passed about this issue since paternity can be determined to about 99%.

I think any case of faaud can be prosecuted. I would think the woman could only be prosecuted to the amount of money she fraudulently received and on the bssis of fraud laws. Likely she would earn prison time if she had no ability to pay back the man.

I suspect women who pull such action are woefully ignorant of the fact that they could face prosecution for such shenanigans and prison time trying to secure "ffee money."

You've got to be pretty foolish to go through with a pregnancy and having to r aise a child to make money. Sounds pitiful on too many fronts to consider rational..

There aren't that many "wealthy" men to dupe in this way and with current DNA tests, a man could avoid supporting a woman if the child's DNA didn't match the father's. HOpefully a man chooses a woman who brings more to a relationship than a pretty face and a uterus...

But, there are some who don't care that much. That would be why they end up in these situations.

Most men have average income and are not wealthy and I believe most women aren't gold diggers. Most humans are looking for good, longterm reationships. Not bank accounts. Don't believe the hype

If you wanted to somehow make this man's fault, then here's a way to do it. Most men, in my experience, are reluctant to have their children get DNA tested because they are afraid of what they may find out.

Not making it men's fault. Saying it's unlikely in most cases. But if a man IS wealthy, and has suspicions, I'd certainly do the test. Would mean peace of mind. In my own case my son looks very much like his father, even sounds like him. Looks like both of us and is the right height! If there was ever any doubt, do a DNA test. I've urged my son to do ancestry which I've paid for to examine all the lines. I think it's fun.

If ever someone didn't want a DNA test, or ancestry test, that would be a giant red flag. Too many ways to find out these days...

The situation that I run into repeatedly is that when a man has children, as long as the woman has not given him a lot of cause to be suspicious, then he won't do any DNA testing on his kids unless and until the woman files a paternity suit or a divorce action. In which case he will, but by that time it will be too late. In California, you have two years to challenge paternity, and after that, even if the kid isn't yours, you get to pay for him anyway as a man.

For a child to grow up with confusion who their biological family is.
And the emotional impact it has on the innocent family.

"Greedy bitch" is not necessarily a psychiatric illness. Women do this because they want to name the wealthy guy as the biological father so they can get more money. Not that they like him better.

I believe so. She didn't just waste a man's emotional investment and time but all his resources. There should be a law that charges her a huge fine, where she's either forced to work hard to pay back all that money he spent (penny by penny) or spent prison time. They give the rest of us loyal women a bad name.

An Australian court convicted such a woman of fraud. Unfortunately the decision got reversed in our High Court by a female Justice who had cheated on her husband.

I think the lower Federal Court ruling should stand.

Thanks. Fascinating. The non-father received financial relief under statute, the constitutionality of which was not at issue. But he lost in his bad for damages for psychological harm under the common law tort of deceit. Neither of which relates to criminality.

@MrChinaski We were all barracking for him. The female justice argued it was bad public policy to hold women accountable for where they got their pregnancy as I remember.

Yes it was civil but it was still obtaining money by deception. Unfortunately the Australian parliament tends to back judge made law with legislation instead of putting the Justices in their place and over-riding their made law with more reasonable legislation.

Along similar lines we now have common law marriage despite protests there is no common law marriage in Australia. If a girl you have spent 2 years and 1 second with can take you to the same divorce court, I think that qualifies as common law marriage.

But that doesn't mean there should not be some compensation packages involved, depending on status of adults involved.

But as with a lot of legal matters, things are rarely straight forward.

Okay, you didn't answer. New York appears to be the only state where it's probably illegal. You can do it anywhere else, and you don't need Mother's knowledge or consent to do it.
