Where if her husband isn’t the father she should face criminal charges.
If she tells him that it's not his kid, then I don't see how it can be fraud.
If she doesn't tell him, and he raises a kid emotionally and financially, I could see it being a criminal and/or a civil offense. Although I'm not sure if it would be considered fraud.
It's certainly a shitty thing for a woman to do. And you have to consider the affect on the child if they found out. I think that would suck for the kid more than it sucks for the "father". It could even affect the siblings and grandparents. It could especially affect the paternal grandparents, who aren't really the grandparents.
It's a complicated issue. You could argue that it's actually better for everyone involved to withhold the truth. It's the kind of thing that should never happen in the first place. It's a lose-lose kind of thing.
Also consider that in most US states, it's perfectly legal for a spouse to cheat. But in other states it can be a felony to cheat. In at least one state, it's a crime for the person the spouse cheated with, even if they are single.
Medically, this is similar to adoption in some ways. Adoption records are generally sealed forever, unless both parties agree to unseal them. A common exception is to obtain medical history. Knowing the genetic history can potentially affect the health and diagnosis of the child. So in adoption cases, the courts often allow limited unsealing of medical history of the biological parents.

Paternity fraud is shockingly common, which is tragic because it means there are many men have children in the world who they will never know, and there are children who will never know their real fathers, simply because of the dishonesty and selfishness of women and the fact that society doesn't care about fathers' rights.
The opinions of many women on this subject is very telling. In the poll, half of them think paternity shouldn't be punishable. Disgusting.
No man should ever have to pay child support for a child that isn't his, which routinely happens even in cases where he and the child's mother are no together. That is patently fraud if the mother knows he isn't the father. Also, a man, whether married to the mother of the child or not, has an absolute right to know if the child is his or not and he can decide whether or not he wants to take on the role of father.

Yes, it should be at least a civil crime. In the moonbat state that I live in if a guy finds out his wife cheated on him and the kid that he thought was his really belongs to some other guy , the guy could get divorces but still be on the hook for child support
Actually this is not a bad idea, pity i never thought of it. Yes it should be and women should have to pay all the money back or face prison. They could have the money paid automatically out of her wages or benefits.
I see only half of all women support this at the time of my voting, any women who disagrees with this must hate men.
There have been many studies on the prevalence of paternity fraud. Most show that roughly 1 in every 10 children is being raised by a man who doesn't know he is not the child's biological father. Others show the rate is much higher. The fact that this is not seen as a problem worthy of serious legal consequences is another example of how society does not value men's rights.
I think it might not be that easy to convict women of paternity fraud, so perhaps it should be a civil crime only (as should nonpayment of child support).
Yes. 18 years in prison, plus repay the money he has spent, plus damages based on how long the fraud lasted because that is time stolen from the man's life.
Definitely should be punishable by jail time. Defrauding a guy and forcing him to raise another guys child because she cheated on him. It's why we need mandatory paternity testing at birth.
Well technically she shouldn't go to jail for letting another man impregnate her, that's like saying a woman gets charged for letting a man have intercourse with her, so it wouldn't make any sense all together, so if anything the man that impregnated her should face criminal charges.
It should, and it should be mandatory to have DNA test at birth.
But we know why they won't do it, they know that the number of children from cheating wives is much higher than we think, and they don't want to show that.
Absolutely. Women have too many protections, rights and benefits. The world would be a far better place without such privileges
If she purposely tricked the man into believing that's his child and the man invested financially into her and the child then yes if the man decides to file a lawsuit.
Yes. And paternity tests should be mandatory too.
No, why would you want to throw a child's mother in jail and leave the child motherless? That's horrible.
She should have to pay the man alimony for the rest of her life if that happens.
Yes but she should only be obligated to compensate him financially.
Why? It makes no sense
criminal charges sounds harsh maybe civil
How do you prove it?
Yes, because it's fraud.
Simple justice. Fuck around and find out.
Of course it should
