How many years would you sentence Derek Chauvin to if you were the Judge of his court case?

The guideline sentence for second-degree murder is 10.5 years, and the convictions on the other charges would almost always run concurrently, so usually, he would get about 10 years with no aggravating factors.

However, the state is arguing that multiple aggravating factors exist which would increase his sentence. These are:

First, that George Floyd was “particularly vulnerable” when he was killed by Chauvin. This is based on the facts that Floyd’s arms were handcuffed behind his back, that Chauvin pressed him into the street, and that Floyd was rendered unconscious.

Second, that Derek Chauvin’s conduct qualifies as an abuse of his position of authority, committed while a police officer and in full uniform at the time of the offense.

Third, that there are additional aggravating factors applicable to the facts of this case, and these additional factors include the argument that Floyd was treated with particular cruelty, that Chauvin committed his crimes as part of a group of three or more persons, and that Chauvin committed his crime in the presence of, and witnessed by, multiple minor children.

When aggravating factors are present, the base guideline sentence is usually doubled which seems fair to me, and I would give him 20 years instead of 10.

All of this is, of course, up to the discretion of the Judge.

40 years with parole granted after 1 year of good behavior. The media would publish the 40 years which would satisfy those desiring maximum punishment, but still he would be released in 1 year and after he is no longer in the news and the media has found other issues.
