How do you deal with irresponsible employers?

Question

Mine have been acting very irresponsibly.

Since I broke my leg, I was unable to work for 2 months, I am already recovering and must be able to go back to work pretty soon but my work visa expires in 3 weeks and even though they have promised they’ll apply for a new one very soon, they have been acting very slow.

When I contact or call them, they don’t reply on time and reply days later, telling me they’ll do everything and not to worry.

Of course, I worry because if they don’t do it on time, I’ll have to relocate back to my country and go through all this when all I can do is walk on one leg and crutches.

I have called them and they haven’t answered, they are telling me, they will apply for a new visa right in time, but when is in time, when there’s only 2-3 weeks left?

I don’t really know what to do now, there’s not much I can do while I am not able to walk. It’s very stressful and disappointing and I feel lost.

How do I push them to be faster and more responsible about this process?

I think that they are trying to get rid of you by letting your visa expire so you are sent back. This way you won't sue them for wrongful termination. They do not eat to keep somebody on the payroll that will not be able to work for a few more months. You need to keep in HR and nicely mention that if your visa expires you will sue them. Get a lawyer to cook up something good that they will pay attention to.

To be honest, you can't...

You can call them and remind them, but it's all you can do. I was countless times in such situations... nothing nice, a lot of stress...

I hope they will really do it on time. Fingers crossed.

Be annoying. If you can find them, throw a fit over this if you need to. they ain't taking it seriously are you are, and I wouldn't put my trust into some bastards who don't communicate properly.

Remember, in China an individual worker or citizen has zero meaning. They only care about the fate of the whole entity, in this case, the company. So, if they have a shortlist of alternative workers lined up that could replace you, everything is fine with them.

I don't know if you recall , but we spoke briefly about Chinese employers , they are hopeless , what they say and do are two different things , the only thing they absolutely understand is super direct , call her up directly and say look , I'm starting to really stress about this VISA , and I really need this done this week...

If you lose the right to work you could try to sue the company for lost earnings, relocation costs, etc depending on the laws of the country you've been hired in, not where the company is headquartered. It's messy and expensive and there's no guarantee of winning, but even if it's a Chinese company they have to employ using local laws.

Can't suggest anything other than quietly mentioning that if it gets to a week or less with no visa...

I think you should start looking for a new job. This kind of behavior is usually an indicator of irresponsibility in other areas, particularly financial. Also, You probably should apply for the visa yourself if you are able to do that. I would not suggest that you rely on these people to become responsible all of a sudden.

Lol you look so fun in your avi but that’s why a lot of businesses/jobs that require no real skills whether it be more hands on like a trade or something or a job that needed you to have an extensive academic background have such high turnover rates. Just fire them & find someone more competent.

Nothing really. Especially when it comes to immigration. When HR was dragging its feet on a contract renewal, I let my supervisor know that I wasn’t sure if it was intended but I was happy to ride off into the sunset… Someone promptly had a fit at HR and my letter came the next day. Don’t be desperate. You’re great. The right thing will happen.

it seems like they're giving you space to recover and don't want to bother you, however it is strange that they have enacted sooner.

I would talk with yout director/manager further up from your line manager, compose an email expressing your concerns in a well written manor

Can the Chinese government be of ANY help whatsoever? Can you call them and have it logged that you're trying to work with your employer in good faith but they are not responding? I bet they won't arbitrate anything. But the idea is to leave a paper trail so you have something to defend yourself if your employer continues to stall.

Visas cannot be rushed... Do not try it either If you already hired an agency with a good reputation then just trust the process and be patient... especially at China

If you received this job through an agency, then you need to go to that agency. They will be the ones to make sure that your Visa does not run out.
