Biological mother decides she doesn't want the baby as in doesn't want the pregnancy or doesn't want the baby as in after birth? The later is what she has contracted to do.
In terms of the father is that the surrogate mother's husband or say the boyfriend of the biological mother? I would guess the biological father has no say. In Australia semen is regarded as a free gift and once it is ejaculated the guy cannot say what is done with it. This came out in a sperm theft case. I don't know if in other parts of the greater anglo sphere this would be the case but property rights tend to be similar.
If the father is the husband of the surrogate mom then I would think he is likely in the contract and has the rights the contract gives. Also it might be the surrogates mom's ova.
I would agree with anyone who objects to the free gift conception of semen particularly when it is put into a condom. It is not a reasonable situation that a girl pushes the used condom inside her and the guy ends up paying for a baby he didn't consent to.

Having been corrected on which is which, depending on the contract the biological father could have rights to collect the child. It would be all contract law as to what could happen.
In fact there has been at least one guy who has chosen a surrogate mom to produce a baby as he didn't want to risk a wife taking his child away from him.
They should both have a say about it but it's a mother doesn't want it the father should get it especially if he has a good job he has a good foundation there's no reason why the father should not get the baby

Gods that's difficult. Short answer in my opinion would be to ensure that the father will commit to caring for the child regardless of the outcome (ex. he'll still take on the child and make sure they're at least put in a proper long-term, trustworthy foster home if his wife says no or chooses a divorce over the issue). If not, an abortion may be in order. But for real you might want to check with like a lawyer or something on this one... It might get messy.
I do understand the argument that the could shouldn't be able to back out and if the surrogate mother is pro-life then the baby's getting born as far as I'm concerned, but if she doesn't have a moral issue with the abortion and doesn't want to take the child if the couple doesn't want to, I'm not sure she should have to go through with the pregnancy. I could never be a surrogate simply due to the emotional complexity of the role.
In the case of surrogacy, you go with the party that's still paying you, but it's really shitty to ask someone to carry a child for you and then back out. Most have contracts drawn up for this kind of thing anyway.

I would imagine that there are plenty of lawyer-speak contracts that are signed well before such a sequence of events were to take place.
I doubt that abortion would be included in contractual options.
What an even more sadistic world it would be if abortion was listed as a way "out" of such a contract.
If they first decided they wanted a child and got someone else to carry out the pregnancy they shouldn't have the right to back out of it. You need to be 100% certain that you want a kid if you do this kind of thing. When they play around with such an important decision they need to feel the consequences and raise the baby like proper parents.
In the case of a third party like a surrogate deferring to the biological parents as here, I would say if either decides to keep the child then she should carry through with the pregnancy. Actually, there is likely a stip in the contract that she go to term except in cases where it is not possible.

That decision would be covered by the surrogacy contract, which generally requires the surrogate mother to carry the baby to term, unless there is a health risk to her.
The unborn child is certainly wanted , so the question is an absolute no brainer , certainly go ahead.
