What would you do in this scenario?

You were with your partner for 15 years and had kids together. Your partner has told you the entire time you knew them that they wanted to be cremated when they die and have their ashes released on a mountaintop. They have also expressed extreme dislike of the idea of being buried.

However, they die one day, and you realize they did not write a will. Their parents are devout Christians and feel strongly about them being buried. Both your kids and you know your partner better than anyone and want to honour their wishes, but everyone else that knew that them, always thought they would want to be buried because of the family they come from.

What's your move in this situation?

I actually had a similar thing occur in December 2018. My double first cousins and roommate died at age 57. His estranged son only could take possession of his body. I informed him that he strongly wanted to rest beside his dad and brother. The son cremated him and has his remains in an urn. ⚱️
He also inherited 500k.

Yeah, but in his not defense, but, both parents were drug addicts. Randy told me this, my cousin. But he had been clean and sober since 2005. This was 2018. During that time he amassed half a million dollars driving a truck. The son was very quiet and he let his wife do all the talking. But he should have let me take care of it. I was going to pay for it but he wouldn't budge. It was like he was getting payback. I couldn't very well say this but it's what it felt like. He and Uncle Don weee real close and he wanted to be beside him.

Funerals aren't for the dead they're for the living to help them cope. This is the last thing you'd do for a partner and so going against their wishes would hang heavily on your conscious for years.

But given the parents beliefs I'd be getting a the priest to have a little chat with them.

Man, even though I know this is hypothetical, just thinking about it really sucks... But I’d respect his wishes and have him cremated, because fulfilling someone’s last wish is the truest way to honour them and bring them peace.

When you marry as far as I'm aware you become nect of kin and primary over all decisions. Mummy and daddy lose that right. So I'd say you stick to your partners wishes no matter what. And they shpuld have known anyways if they claim to have been close to their son/daughter.

Assume they wasn't close to their son/daughter? Then they have even less say on the matter. The spouse trumps all others opinions and beliefs if they are acting upon the person's wishes and not their own. Because imagine the opposite, the family want to cremate and scatter the ashes. The dead person wanted that. But the spouse is Christian and believes in burial? Unfortunately I think the spouse will get their wish over family without a will. So lesson to be learned? Have a spouse you trust and believes in same wishes as you. And/or make a will!! Even if it's just written and not legalised. Just having your intentions written and distributed among family and friends would help if a debate starts up.

i would cremate my partner, and a talk with their family. Because honestly it would break my heart to not respect my partner’s decision when it comes to how they want their body to be processed after death.

Get a lawyer, argue for the cremation and use the fact that the relationship held with the spouse (common law or otherwise) is more recent and holds more sway over the remains than their parents.
