I wouldn’t take Spartacus for historical accuracy. More like a hypersexualized bondage version of Rome. Loosely inspired by Roman clothing.

But they were more open in some ways. It also varies a lot over time. Partly dependent on how much a prude the current emperor was.

They also didn’t really have police to enforce laws. Mostly they only have a crap about crimes against the empire. As far as personal crime or person on person. They only cared if someone made a complaint. No complaint, no crime.
