Although not an amateur of such cream scones, and not competent in that field, it seems to me in all logic that the cream should be on top, as with the Cornish ones. I guess that the scones will be more stable and less prone to be annoyingly slippery when eating them.

Clearly Devonian, because I like better how the word sounds, plus there is a nice croissant here, it's lovely !

I wasn't even aware there was a proper way, but I wouldn't turn down either one of the choices shown. Just guessing however it is likely that the cornish version would be the proper one with the filling between the biscuit and whipped cream.
Definitely the Cornish way... Apparently our late Majesty the Queen (UK) preferred it this way too.

The correct way is butter - NEVER MARGARINE - then Jam, then Clotted Cream. That's not clotted from the pictures. It looks whipped.

Cream should always be on top, for scones or anything else... waffles, Ice cream, etc.
Both are proper depending on region, but I think Iād like the Cornish way better
