+1 yIt's legal to take a picture of someone in public, even without their permission, but that doesn't make what they did ethical.
Sometimes I want to take a pic of someone. Maybe I like their shirt and want to search Amazon for it later, or I think a candid pic of them should be on facebook with some words of support. Maybe they're the next Sad Keanu.
But I always asked for permission before if I could, and always asked permission after if I couldn't ask before. If they wanted a copy, they got a copy. And if they ask me to delete it, even ten years later, I delete it. I don't own anyone's appearance other than my own.
Even if what he did is legal, I would still support you if you ripped the phone from his hands and smashed it to dust. I don't believe anyone should have the right to take photos of someone else without their permission if they're the subject of that picture.
EXAMPLE: I was once in line at an amusement park line with some friends, and took photos of them. I noticed some girls behind them, and made a motion indicating that I'd like to take a pic of them. They shook their heads as a no, I gave them a thumbs-up and a smile, and I moved on. When I got home, I cropped them out of my other photos as best I could, blurring them when I couldn't.00 Reply

:/ Unfortunately there's really nothing you can do about that except... boldly take a picture of him right back and let him know it will be posted all over social media warning other females if they see him. Respecting privacy and being courteous of others is a two way street. It's much worse for a guy's face to be plastered all over social media with warnings attached to it than whatever he had planned for your picture. :)

Plus, think about people who take photos with people in the background. Even though they didn't INTEND to get the people in the background, you may still be in someone's family or group photo (in the background.)

I agree, he probably was taking your pic. Didn't you read that? However, you don't KNOW he was. And I have had people be completely convinced I was taking their picture when I was not.
I get that you're creeped out and angry about it and I understand it. Until you actually see the picture, you do not know with 100% certainty, just like the men who accused me didn't know with 100% certainty that I took their picture (and in their case, they were dead wrong). However, so many people are advising you that you should have pepper sprayed him, should have smashed his phone, should have publically humiliated him. I advise caution in doing that. Taking pics in public is, for the most part, perfectly legal (and for a myriad of reasons, it should be). Smashing property isn't. Assault isn't. Slander isn't.

+1 yIf you live in the states, what he did is sadly legal, unless that train service is considered a private entity. If you live outside the states, I would check for the legality there. In many countries where it's illegal, some people also do it, because nobody with authority taught them it's illegal.

Neither of us KNOWS that he was taking a picture of the girl, since neither of us were there. We have only her word. By the way, I believe she believes what she's saying. But how do you know he was taking a picture of her? How do you know she was center frame unless you saw the picture yourself? And if she is wrong (and being only human, she might be), would you be OK with smashing people's property if she was not the focus of the picture, but just happened to be in the frame?
I'd be willing to bet you've taken pictures in public. Would you be OK if someone you happen to catch in the frame of the pic walk up to you and destroy your phone because you didn't have her permission? Is it OK for people in the background of any picture you've taken in public to walk up to you and destroy your phone?
Would you be OK if a police officer smashed the phone of someone who was filming him commit an illegal act?

Furthermore, if it's illegal without consent, how is it that the Rodney King beating vid wasn't tossed out of court? How is it that the NUMEROUS police brutality videos aren't tossed out of court? How is it that bank cameras' footage are admissible in courts even when they are used as evidence for crimes which were not committed on the bank's property? How is it that ANY vid or pic taken by a private individual is not tossed out of court immediately as evidence on the grounds that it is illegally acquired evidence?

Well, the reality of it is in order for it to be illegal, you would have to ban virtually ALL public photography. Have you ever taken pictures in public? If so (and I'm willing to bet you have), then I'm pretty sure you probably have a few people in the background of at least some of your pictures. If you want to make it illegal to take people's pics without their consent, you'd have to get the consent of every single human being in the frame of every single picture you have. It would then be illegal for reporters to show up and take pictures of events. All those pics of 9-11 of firefighters, police, and ordinary citizens would be illegal. Right now, I'm looking at pictures my friend took of me and her kids at the Getty museum. There are literally dozens of people in the frames of dozens of pictures for whom my friend didn't get the consent of.
I get the creep factor, I do. However, I'd rather live in a free society where people are permitted to take pics in public... - +1 y
@Bluemax and yeah the two cops I encountered told me that after I had a spat with two rude neighbours. I told them I was taking a picture of what she had done on my lawn and they said it wasn't legal to take a picture of her. One of those same cops ended up on the news for stealing evidence and he bothered other people
