Under current law in the USA, it is a three party contract between the married partners and the state. The state retains the power to alters the terms and conditions at any time. In most places either partner can violate the terms without punishment, and terminate the contract without penalty. That does not mean that the partner who erns more will not have to pay, but only that under no-fault there is no penalty for cheating or otherwise violating the marriage contract.
