Under current law in the USA, it is a three party contract between the married partners and the state. The state retains the power to alters the terms and conditions at any time. In most places either partner can violate the terms without punishment, and terminate the contract without penalty. That does not mean that the partner who erns more will not have to pay, but only that under no-fault there is no penalty for cheating or otherwise violating the marriage contract.

There is no binding. There are no obligations in a boyfriend / girlfriend relationship. But there are a ton of obligations in a marriage , not only societal obligations but also legal obligations.

In a boyfriend / girlfriend relationship, YOU are not the one responsible for the damage. Your boyfriend would be obligated to pay for it, not you.
