What are y'alls thoughts on this part of the prenup?

As prior mentioned, I was given a prenuptial template from my grandparents and promised them to use it whenever I marry.

The part I'm talking about is the infidelity:

Where if one is unfaithful or breaks a vow, they get 25-50 percent of the wealth newly accumulated from the spouse AFTER marriage.

In other words, let us say after I got married, I have a net worth of $20,000,000 prior to marriage but I only make a newly total of 40k throughout the marriage.
If I cheat, she'll only Get 25-50% extra of the newly 40k ONLY.
If she was worth $4500 prior to marriage but accumulated 60k, if she cheats, I only get 25-50% of her newly earned 60k.

It is ensure complete equality. I don't touch her 4500 and she doesn't touch my 20,000,000

That's part of the template. It's to ensure nobody is after each others money. Complete transparency

Hmmm... that's definitely an interesting part of the prenup. I can see why some folks might take issue with the infidelity clause. On the one hand, it does seem fair that the money each person had before the marriage stays separate. But limiting what someone gets if they cheat to only a percentage of what was earned during the marriage does seem a bit harsh.

I guess it all depends on how much each person trusts the other not to be unfaithful. If you really don't think it'll be an issue, then maybe that clause isn't a big deal. But people aren't perfect, you know? Feelings can change over time. Maybe there could be a compromise, like each getting a set percentage of the total assets if there's an affair, not just what was earned while married. Or take out that part altogether.

Ultimately you've gotta do what feels right for your situation. Making sure both people feel protected financially is important. But you don't want to show that you don't trust each other, either. Tricky stuff! What do the other folks you're marrying think about it?

The only way I could agree with a prenuptial agreement with this stipulation in it is if it applied only to the guy, because, in my opinion, extramarital sex, when engaged in by the female is often a vastly beneficial element within a marriage, whereas outside affairs participated in by the male are almost always a very harmful event. This is my opinion only.

You do realize that's not how the law works, right?

Lets say that was hypothetically true, did this "judge" get fired, his licenses taken away and barred from law? And possibly charged with obstruction?

And possibly a new judge to undo the "reversal" to prevent a lawsuit?

Because unless any of that happened afterwards. All of this:

Also Nikki, you probably don't know this but I'm a prelaw major 🙂

And also I forgot to add, judges don't have the ability to just "reverse" a prenuptial agreement AFTER it was signed, under the account one party thinks it's "unfair".

She signed it, the second she decided to pick up the pen and land the ink on the paper, she legally stated it was fair 1000x over. You can't go back on legally binding contracts simply because you want to.

That's why they say " Read fine print " because once you signed it, even judges can't overturn contracts just willingly.

I would consult an attorney to review everything before anybody signs anything to make sure it's rock solid. There's a lot of shitty attorneys so make sure it's a good one.
