It doesn’t matter, family court will work with the mom and actually encourage her to file for sole custody by using bogus restraining orders. In most states they are rabidly misandrist and all states are “no due process” as this is a civil matter. Some states outright ignore the criminal allegations made by the mother against the father/ex-husband to continue the case in a civil court venue because moving parts of or the entire case to a criminal court where evidence must be examined according to the guidelines of due process procedure. Meaning she’ll likely lose and lose the kids if she is lying.
It is better to live together, be exclusive, and raise a family without marriage. They could even get married religiously (which is all that should matter), but not legally (don't file the paperwork). Marriage is a terrible thing for men in the USA and has no benefits for them, only severe and likely risks.

Not sure if it's still the case, but the father doesn't have as many rights to sue for custody etc if he's not married to the mother of his children.
Marriage secures the right as a father, even if it risks losing everything.
But then a father always risks losing everything for his kids. Every second of every day.

Marriage is like a hurricane there is a lot of blowing in the beginning & when it’s all said & done your house is gone. Marriage only benefits divorced lawyers & women nowadays & marriage is all about the three rings. Engagement ring, wedding ring & suffering.

I believe that most states have “Common Law Marriages.” Once you live together and you especially have a child together. You are essentially married. The woman will have the same benefits as if the paperwork was signed on the marriage certificate.
