Do you think this counts as counterfeit?

So apparently some manufacturing companies for big brands make products exactly how they make the product for the big companies, same fabrics or materials and make it exactly the same but sell it behind their back to others that aren't the company they make items for, which some would say is counterfeit although technically it isn't cause they are still made exactly the same and they are made by the original manufacturers that make the real products so some say it's basically real others say it's just the best replicas and the best way to counterfeit products, the only difference is that the products, branded and all are sold through a different source that isn't the original company, so for example the manufacturers that make Nike shoes, they make the shoes exactly how they make them, but they sell it to some infamous seller instead of making them for Nike, usually as a side hustle while they still make them for Nike as their main source of income but some infamous seller is still out there selling Nike shoes that were made by the original Nike manufacturers.
