When it comes to overhanging trees you are allowed to cut the branches that are overhanging. As for your neighbor you can always ask them if they can trim the branches back & if they give you a weird look or a hard time cut the branches that are overhanging & throw it in their yard.

You are allowed to cut the branches & only the part that hangs over on to your property & if you are unsure you can always check with the city & read ordinances on it. You can always file a complaint with your city & see if they can order your neighbor to cut it if deemed unsafe in anyway or if they can come up with another reason why.

I had this problem. What happened? Is my neighbors cut that part of our tree which was over their yard. It made the tree look disgusting. Those people real assholes. I'm glad the husband died shortly after that.

It is a civil issue.

Keep in mind if you cut branches you will unbalance the tree. If it then falls after, at any point, you are then responsible.

If you cut it, it’s property damage. Your neighbor has to be the one to trim it legally, or you need to get permission.

Check your local laws, but usually you can cut off (or use, in case of fruits, etc.) whatever invades your property.

Ask a real estate attorney. I am not a lawyer but I believe you can trim the tree at the property line.
