Can I sue my ex for throwing my stuff out without notifying me first?

I broke up with my ex because he cheated on me. One day he came home & I had moved out. I originally only took necessities & was going to go back for the rest but he had thrown it out. He never told me he was going to do that & being that I left him all our valuables (flat screan tv, swead sofa, queen size bed, great apartment, game systemS, dvd's, cd's, video games, thousands of dollars worth of collector item swords, etc...) The least he could have done is give me my things that had sentimental value... Can I sue him?

You can sue anyone for anything. If the cost of your belongings is over $5,000 will need a lawyer. If you feel you want to sue then it would be wise to talk to a layer in your state rather than people on a chat forum. That aside, he could easily say that he thought you moved out and left your stuff on the front porch for you to pick up or that he tried to call you to pick up your stuff numerous times after the break up and you ignored him and thus he was unable to contact you to tell you to pick up your stuff.

Yes you can. Those are your possessions and he ruined them. Any kind of proof that you purchased them (reciepts) and proof that he threw them out would be necessary to get any money though unless he admits to it.

The items I'm referring to are from when I was a child. Pictures, trophies, cap & gown sort a things.There's no way to prove purchase...

You'll only be able to re-claim value if you can prove that the items had value in court. So maybe some sort of appraisal?

But you may need some proof that those things were yours.

Do you have receipts for any of those items?

If not, try to catch him admitting that he destroyed your items through a phone conversation or through texting.

Its was an apartment which we both paid for. With the price & location of the apartment, he should be greatful that I left instead of fighting him for it. After all, HE's the one that cheated...
