Can she sue me for this? (ebay, mercari stuff)?

I've sold an expensive coat $1200 on an app called mercari, it's similar to ebay but you have 3 days to examine the item and decide if you want to return it if it is not as described. In the process of doing so you need to give them pictures of evidence of how it's not as described. This item is 100% authentic. In this app, you contact mercari and submit a return request, they give you a return label and when it shows that it's delivered to me they give her her money back.

The day after it was delivered she personally messaged me saying that she wants to return it because of a tiny flaw that i overlooked. I told her to do so, assuming she submitted a request and all of that. she asked me for my address and name which I thought was weird cause that would all be in the label mercari gives you. I didn't hear from her for 4 days nor did I get a notification from mercari that she submitted a return request, she didn't give me a tracking number or anything. So I asked mercari to release my funds and they did, as it's their policy to release funds if I don't hear from the buyer or if they didn't submit a return request.

So now I have my funds and the jacket arrived today, so she DID actually return it. I am not sure if I'm obligated to give her money back though, I would very prefer to send back the jacket.
I;m thinking about sending back the jacket. Could she sue me for this?

Can she sue you? Absolutely! Can she won? Possibly. Won't know unless she tries. Consider this thought... Someone who can afford a $1200 coat, can easily afford to sue you, regardless which state you live in.

At the same time you had an agreement with her using the service to sell the coat. Although she got the coat shipped slightly later than the "service" (Mercari) states, she DID return it in a reasonable time. The smart (and best) thing is to simply return her money, and try to resell the coat, indicating the tiny flaw, the next time you advertise it. Be a good business woman and use good ethics here. I know this is not what you expected, but consider the future costs you may incur if you don't.

Technically yes she can sue you. will they be able to hunt you down for it probably. Will she be able to get her money back that's highly unlikely because because you're far away. But, she could find a way to do it if she was really upset.

Ask yourself this would you be upset If someone tried to return their product to a scumbag seller that also wanted to keep the money badly?

Give her back her money. There must be a way on that app to send it back. It's not right for you to keep the money after she has sent the jacket back. I think she could probably sue you, but that's not the reason you shouldn't keep the money. It's just wrong to keep it. Just message her and tell her there was a misunderstanding since you didn't hear back from her, and give her the money.

so she had your address from you giving it to her or through the company app, I would call the company and ask to look into if she made a request to return it. the right thing to do would be to return her money

She brought coat off you>she got the jacket> wasn't happy with it>she sends it back to you

You need to reimburse the money she gave you. Unless you want debt collectors at your door in a month or two.

She can take you to small claims court for as little as 300$.

But if your value system really says you can steal a months wages from someone, I think you can jew the shit out of that lady and get away with it scott free. Make sure you tell all your scumbag friends and slimy family how you took advantage of a stranger who trusted you.

She may not have done things the official way, but you should give her her money back. Otherwise, it IS fraud. I would make sure to tell her that it's not the way it works though. by the way do not send money by mail... Use paypal or something.

I just thought of this. Why doesn't she put up the coat on mercari and you buy it immediately? Or maybe talk to someone at mercari. They may help you find a way to give her back her money.

No, it's not practical to sue across state lines for $1200. But do the right thing, send her money back, and resell it.

If she didn't return it during the 3 day period then you don't have to return her money but if she returned it on time then she can sue you for breach of contract and win
