Just because something is legal, that doesn't make it right/moral. Also, just because something is illegal, that doesn't mean it is wrong/immoral.

The government profits from cheating, and so do numerous companies that give campaign donations to government officials.

It is if you're married. Criminal prosecutions for adultery are almost entirely limited to the military now, but in civil divorce court you can pay a heavy price for it if your spouse can prove it.

I believe its due in part to the separation of church and government contained in our constitution. Many religions have horrendous penalties for cheating women but not so much for men. In all fairness and justice for all, how can you persecute one sex and not the other in the same way for the same offences. Some States do allow legal repercussions but that that the exception rather than the norm. Its become so common that its been downgraded in societies eyes and not worth the courts time. IMHO

In some states there are. Nothing like life threatening. But in some states if you cheat while in a marriage ending in divorce the partner gets everything.

Sadly because the USA has become a reprobate nation, along with various other nations. Divorce is (I think) still a possibility for this kind of behavior, but ONLY for this type of behavior (If I'm interpreting God's Word correctly)
