1 yNo. But sabotaging someone's relationship should be. It was called "spousal alienation" for a while, and it was very much illegal. I'm not sure if it still is though. It should be illegal. People who feel like they're losing their life partners can be driven to do some really terrifying stuff because they don't feel like they have anything more to lose.
I'm not a violent guy and I'll never advocate for hurting someone. But there are certain types of people the world would be better off without. The kinds of people who would intentionally go out of their way to destroy someone else's marriage and social relationships absolutely fall into that category for me. Especially the people who do it because "it's fun."
You have to be a special kind of turd to think it was okay to mess with someone's head like that. And there are countless stories of people doing things like that and the absolutely insane amount of damage that happens as a result.
People who feel like they have nothing to lose are extremely fucking dangerous people. Do not EVER mess with that. Seriously.

Interesting question. Never really thought about it. I don't like infidelity. I think it's immoral. Should it be illegal though. My original thought was no, because I couldn't think of a way to really enforce it. How do you determine if someone is cheating? Are police going to investigate it? Then I thought that it may make sense to make it illegal in the same vein as "fighting words". If I were married and my spouse cheated on me, I could see doing some very violent things. I think it's the expected outcome of discovering the cheating. Should I then be punished for acting in a way that everyone knows is likely in that situation? Yeah, I probably still should be. Should the person who did the thing to put me into the situation where a reasonable person would be likely to be violent also be culpable? I don't see why not. It's like putting a child on the train tracks and acting surprised when a train runs them over. Sure, you didn't kill the kid, but you're certainly somewhat culpable.
I'll have to think over it some more.

1 yYes I actually think so depending on the situation. I think if the partner did nothing wrong to deserve being cheated on the person who cheated should pay a fine and only if they are married because that other person has wasted there time and money on a relationship with someone who didn't respect them. That person may have moved to another town/country to be with that person and given up opportunities and time with loved ones for that person to just disrespect that.
People should take marriage more seriously and if they don't feel in love with that person anymore they should do the right thing and be up front about it.
I hate cheats and I've seen how it ruins life's and families especially the children. It's better to be divorced than to live a lie

1 yPerhaps the government should regulate everything in life.
If they picked your spouse for you, maybe they would be better at match making. Leaving us to our own to make that choice is not working well when you consider the divorce rate and all the broken families that go along with it.
Tell you how many kids you should have? Where you can live and work?
People make crappy choices all the time that results in their undoing.
Hell, they should even pick the ring for you too, just to make sure you don’t overspend.Sounds euphoric, don’t it?

I'm here to spice up your relationship queries on Girls Ask Guys! So, let's dive into this juicy topic! Making cheating a crime is quite the heated debate. While deceit in love can shatter hearts, turning it into a criminal offense might be a stretch. Legal systems usually handle tangible harms, not emotional ones. Cheating is a red flag that hints at deeper relationship issues. Instead of legal action, focusing on understanding, communication, or even moving on might be the way to go. Remember, love can be complex and not all crimes need cuffs! 😜💔

Amy isn't gonna go to jail brad.
- 1 y
There is such a thing as "emotional harm/damage" that people can appeal in a court of law. So it's possible to use the legal system and claim emotional harms.
Not the primary reason obviously. But say the way someone cheats damages their credibility in a business - there will be financial loss. Cheating causes ramifications on so many planes (financial, emotional, familial). It's a horrible thing

There would be a lot of people in jail if that was the case lol but I agree there should be some sort of fine or punishment for cheating especially with married couples. They should have a site like Megan’s Law for cheaters , so people can see who’s a cheater or not lol

1 yProbably not. Cheating is more along the lines of being an asshole and a traitor rather than a literal crime you could go to jail for. Like it's wrong for someone (anyone, not just romantic partners) to use you for their benefit and pretend to care about you when they don't, but it's different from like stealing or doing illegal druges, and much, much different from rape, murder, or pedophilia.
Lots of people are assholes in different ways every single day, but we can't just arrest all those assholes just like that, lol. If that was the case we'd arrest like every single teenager or child ever cuz people who are extremely young can be assholes.
06 Reply- 1 y
@Ladsin2 Ah yes. That's exactly it, a traitorous friend, lol. I should've been more specific, haha.
Asker1 yMaybe not arrest them but add them to public registries where people can see that they're a cheater.
Asker1 yThe interjections with your "lol" is condescending not sure if that was intentional or not
Asker1 ySomeone who marries and builds a life and has children with someone who was cheating on them the whole time is simply just "being an asshole" and the victim should just shut up and move and because that level of cheating is the same as name calling in your eyes?
Asker1 yShould fraud no longer be a crime since that's simply "just being an asshole"?

1 yYes, cheating shiuld be illegal, because of the STD risk, you should need to break up before doing anything with another person. Or more accurately, if a person cheats, they get nothing in a divorce, they lose custody of any kids, and if they spread an STD, they are forced to pay a lifetime of substantial monetary compensation to the victim after a set amount of jailtime.
Or rather that would be the ideal, but in reality the government should stay out of the bedroom, because the power needed to pull off that sort of regulation, would be too easily abused.
So no, it should not be illegal. But society should shun you for it.011 Reply
Asker1 ySociety shunning people does absolutely nothing. The most powerful and prominent people are the ones who do crap like this.
If we want the government out of the bedroom, even though relationships exist outside of it as well, fine, what's the alternative?- 1 y
I disagree that shunning people does nothing. To be clear, shunning isn't just calling someone out.
its having the community as a whole exclude you. Want to cheat? fine. Never get laid safely again, never have friends eho dont also cheat again, no one will want to bother with you aside from illegal hookers that likely are carrying STDs and other cheaters.
Natural consequence works when its shoved in their faces from a general public common sense point of view. - 1 y
Also, its not an alternative per say, no gov has the man power to actually enforce regulations on the relationships of that many people. So its not really possible for a gov to do anything about cheating.
- 1 y
Technicslly though, it would be impossible in most cases for a community or a gov to verify a person cheated unless it resulted in a child that was DNA tested, even video and audio footage is fakeable now.
- 1 y
So really only some cheaters would get ostrasized, and the problem would remain unsolvable as a whole.
Asker1 yWhy not just make it legal to deny cheaters human autonomy? Instead of arresting them, give them 0 protection and actions taken against them aren't considered crimes.
Many many many many rich powerful people have cheated, explain how that's possible by being shunned? Are you saying they're being punished and them becoming rich and celebrities is what the punishment looks like? Give clear real life examples because you're defending the status quo and shitting on me for challenging it- 1 y
"Why not just make it legal to deny cheaters human autonomy? Instead of arresting them, give them 0 protection and actions taken against them aren't considered crimes."
For the same reason you dont give a convicted murderer the electric chair anymore.
They could be proven innocent years later as evidence surfaces.
Also for the reason I already mentioned, in that in most cases it would be impossible for a gov or community to verify if someone actually cheated and isn't just being slandered, with the only exception being certain situations where a DNA test proved a baby was conceved by x person at x time when one of the parents had another sexual partner. You would also need to prove that it wasn't a surrogate or sperm clinic donation though, and good look luck with that.
Do you understand how lethally dangerous to its citizens a survellence state would need to be to circumvent all of that? it would make the empire from star wars look tame. Or that said state could deepfake evidence on anyone who disagrees with them, or that there would need to be billions of people in the gov to enforce it.
Its pure fantasy yo expect what you are suggesting. - 1 y
Actually by wanting that level of regulation, you are defending the status quo.
Asker1 yYou're literally saying all crime should be legal because it's not 100% to convict them.
The same arguments you're using against making cheating illegal, can be used for literally every crime.
You're pro shunning people from society and denying them public services, but you don't care about the percentage chances then? Why do you support shunning if you're dmso concerned about the chances of them not being a cheater? It doesn't make sense- 1 y
I'd reccomend re-reading what I said and thinking about it more clearly so you can reply with something that isn't absurd.

It’s like competition to cheat against mens world. They feel thrilled to cheat over men? I mean.. we are stranger anyway. My mom told me she feel like a stranger. And yet she is divorced because of her children. I heard that open relationship doesn’t work either. One side get jealousy all the time. So i dont think it's the answer, but some sort or justice would be nice for the victims.

It is prosecuted, rare doesn’t mean never
Asker1 yWhat's the jail sentence
Depends on the state and the judge in charge of sentencing
Asker1 yThis is like pulling teeth I'm being clear in what I'm asking and you're playing hide the ball. List examples
Asker1 yIt's like asking someone to explain addition and they say "depends on the numbers" and thinking that's a great explanation that teaches someone how to add. You're behaving like a stochastic troll.

Asker1 yYou sound a stupid white troll
And you’re pointlessly angry at someone who doesn’t matter lol
Asker1 yYou're a dumb trump supporter lol
Come on, let’s be real here. Despite it being categorized as a criminal act, why do you think it’s so rarely prosecuted?
Asker1 yBecause of misogynistic bureaucrats, the patriarchy, the fact that most elected officials are cheaters as well.
But they don’t have any influence over whether or not someone is charged with it. The person who suffers as a result of their adultery, their spouse, has that power. Not the judge, or governor. If it’s a crime in that state, why do you think a majority of spouses choose not to press charges?
Asker1 yWomen are usually the victim, and the legal process is unfair to women and they don't serve justice. Same reason women rarely ever report sexual abuse because cops and courts are brutally misogynistic.
Asker1 yIf it's a crime it's supposed to go to a grand jury, but there is so much obstruction due to misogyny
I wouldn’t say it’s unfair to give women the power to send their cheating spouses into the legal system and put them in said system if their spouse is unable to pay his way out
When you are charged as an adult, that follows you for life. Even having a record of small crimes is enough to get you to lose your job
Asker1 ySo then men can just not commit a crime? If the system takes sexual abuse seriously it would happen less. Same with cheating
I don’t think you’re getting what I’m saying: the women, or any victim spouses of adultery, are the ones that choose whether or not to go forward with a criminal charge, not the state.
Asker1 yYes, and you're failing to realize that most women do not come forward due to system sexism prepetuated by society and the state. Women who speak up about any abuse they suffer get brutalized by society and the legal system does nothing
Asker1 yUsing your logic, should rape not be a crime because most rape victims don't come forward and report it?

Asker1 yWhy not in this case specifically? If not jail, what about a permanent record so people can be aware of their behavior and make the choice to be involved with them or not?
- 1 y
Not a terrible idea, but that would create a lot of government bureaucracy
Asker1 yWhat would be your solution to ending cheating or making sure people who have cheated are outed?
Asker1 yIf it's a bureau that works, what's the issue?
- 1 y
I guess. I’m not sure there is a solution. But I admit yours is creative.
Asker1 yMaking it illegal seems like the obvious solution. Ofc it won't stop it outright but it makes it a punishable offense and gives the victims recourse. I don't see any reason to be against that. Why are you?
- 1 y
Because it’s unnecessary government interference in private life. Also, the issue of if the people aren’t married, how do you define whether you’re officially in a relationship or whether you were broken up at the time or whether you had really agreed to be exclusive… lawyers would have a field day with that.
But I like your idea about a person getting a permanent record. The only question is, do we really want to spend taxpayer dollars on that? Is cheating so much of a problem that we need a whole government agency for that?
I have been cheated on before. I was a minor at the time and so was he, which raises additional questions as to the legality of punishing someone for that. It was not fun at all, but I’m not sure legislating it away is the answer.
Plus bear mind that most make politicians are either cheating right now or have cheated at some point in their careers, so they really aren’t gonna want to do this.
Asker1 yThen how hard is it to make a website where people submit reports on people who cheated on them. Like citizen app for reporting dating red flags. And maybe you weren't hurt but many people are. Cheating destroys and takes lives, so it's pretty disgusting for you to handwave it away as not a big issue. The person who cheated on you should have done jail time, a few months of that and he'd never cheat again, would also probably have been some prisoners girlfriend inside. Cheaters are disgusting
Asker1 yMost politicians are criminals and should be thrown in jail, your reasoning for why it shouldn't be crime sounds more and more like reasons why it should. I don't see at all how it would hurt.
- 1 y
I’m just saying I don’t think it will ever pass. And I don’t think it should pass. I’m sorry you were hurt when someone cheated on you, but the answer is to leave them and never look back, not put them in jail. But we can agree to disagree.
Actually in some states it is illegal. Adultery is punishable by a $10 fine, but that only protects married people and it’s so they don’t have to testify in divorce court about their cheating, cause of the Fifth Amendment. And I think one or two states allow a spouse who’s been cheated on to sue the person their partner cheated with for alienation of affections, and some states allow the cheater to get less money in divorce court if the judge decides that’s fair. But I think that’s the best you’re gonna do. The fluidity of unmarried relationships makes it really unlikely that anybody going to try regulating them, and like I said, politicians really don’t want to do this.
Asker1 yYour reasoning are just wrong. It affects the children, families, friends etc. you don't make any case for why those people don't belong in jail. You're just saying they shouldn't be in there.

- 1 y
Beating up or killing someone is a violent crime. That is a legitimate reason to prosecute someone. Hurting someone's feelings is not.
Asker1 ySo you don't recognize mental abuse as legitimate harm and simply "hurting peoples feelings" this site is full of MAGA idiots.
- 1 y
No. If mental abuse was a crime everyone would be in prison because there's always someone who objects to something someone else says. That's what freedom of speech and freedom of association is all about and it's called Liberty. Look it up.
The government has no business interfering in any personal relationship, sexual or otherwise, between consenting adults.
Asker1 ySo if you mentally abuse someone without physically abusing them then that's simply just hurting their feelings and is okay?
Asker1 yI want to be clear you view all mental trauma as simply "hurt feelings"? Yes or no?
- 1 y
That's not the question. The question is should somebody be prosecuted because you had a certain reaction to something they said or did. And the answer is no. It's not up to them to be responsible for your reaction to the things that they do. You are responsible for that not them. You you cannot control what other people say or do but you can control how you react to it and that is your responsibility not theirs.

Asker1 yCan you explain how it always works itself out to where the victim is given justice? Plenty of cheaters give them STDS.
Obviously the government would enforce it, who else do you think enforces the laws? If someone cheats, arrests them, put them on trial and sentences them, that's literally how criminal law works.
Asker1 yIt's ridiculous how naive people are. If I asked you "well who would enforce laws against murder?" What would you say? The same think I would have said.
- 1 y
the government cannot enforce all of the laws that are on the books now, so let's add more laws? There is a murder, or a robbery, hostages, but sorry we are arresting a cheater it might take a while so we will get there when we can. Cheating is not a very high priority crime to tie up precious resources. How many people have been arrested for bigamy last year, I have no clue.
As far as Karma, my ex-wife who was cheating on me ended up getting what she deserved in my eye.
I found her with someone else, I left, my life turned out great, she did not end up with the guy she was cheating on me with, he was married, her next husband turned out to be lazy, wouldn't get a job, she had to struggle to break even, divorced him, and now doesn't have much money to do much of anything now that she retired, she pretty much breaks even.
Not that I wish bad stuff for people, but my feeling is she got what she deserved, and I never got an STD from her, or anyone else. She even admitted that she screwed up, but never apologized to me for doing that.
Asker1 yCan you clarify your criteria for whether something should be illegal or not? It sounds like you don't think murder should be illegal since it still happens.
When it comes to karma, why do you bring it up as if it's justice when you don't want people to be victims of it? Like if he drinks herself to death would you feel she deserves it?
Be clear, what exactly should happen to cheaters and what should the punishment karma unilaterally dishes out be?
Asker1 yYou didn't answer, you vague posted and refused to elaborate. Bye
1 yNo, because it would be impractical to enforce. It would require all people to be in a committed relationship to have sex too. I know cheating is wrong and it’s painful to find out your partner is unfaithful.

1 y🤔🤔.. I don't know, since it's a rather personal matter between two individuals.. I don't think it should be..

1 yAdultery, infidelity, and cheating on your spouse SHOULD definitely be illegal!

1 yBack in my asshole days I cheated. I wouldn't say prison time but I'd be ok if a babe from back in the day sued me.
00 Reply 1.5K opinions shared on Relationships topic. Hell, no, unless it’s made a crime for men who cheat, but not for women.

1 yOnly if we applied the functionally equivalent to the act. If men didn't provide for their women it would be a crime and if women had sex w/another man it would be a crime.

1 yNo, but in marriage it should result in the forfeiture of all marital assets and custody of the children.

Asker1 yWhy not make it illegal?
1.2K opinions shared on Relationships topic. Depends what you're cheating in. Some forms of cheating are a crime.

1 yNo. Last thing we need is the government getting involved in our love life

Asker1 yIm trying to find out why not, obviously a lot of people don't feel it should which is why it's not a crime as of now
Anonymous(36-45)1 yYes, you broke the marriage contract. Breaching a contract is an offense if the contract is to mean anything.

1 yIt certainly should, but what’s a legal team going to be able to do about it?

Asker1 yProve the cheater cheated the. The judge sentences them, like any other fucking crime
Asker1 yI hate that everyone pretends to not remember how the legal process works
- 1 y
Cheating is so much more difficult to prove, though. Also different people have different ideas of what being a cheater even means.
Asker1 yMost men who rap* don't think they did but we agree they should be prosecuted.
- 1 y
As wrong as it is,(and thank goodness we have laws against it), that’s only scratching the surface of what can be seen as cheating.
Asker1 ySure, so why would it be a bad thing to cover all the cases in legislation?
- 1 y
I’ve heard about girls who think their boyfriend so much as looking at other women is cheating. Do you think that should be illegal just because some girls think that?
Asker1 ySure if that's the standards they agreed to. Breach of contract is breach of contract
- 1 y
That’s the problem. We’re not agreeing on everything. There are so many topics with too many contrary opinions to verify a standard. (Sometimes partly because it should always be a standard agreement for both genders.)
Anyway, I’m done talking about this.
Asker1 yAsking people to explain their reasoning is the quickest way to end a conversation, take care
1.4K opinions shared on Relationships topic. No.
But it should be taken into account in a divorce. You cheat, you lose everything.01 Reply
Asker1 yWhy should it not be a crime?
Anonymous(36-45)1 yBelieve it or not it use to be.. In my opinion it should still be, and punished like domestic violence is punished.

1 yAbsolutely! 1 year in prison. For being disloyal and decietful.

1 yProbably not because that's something you do that doesn't involve the law

Asker1 yAre you against the age of consent too?
Asker1 yIf you feel the government should not be involved in any capacity with relationships and sex, you're advocating to get rid of laws against sexual abuse and abolishing age if consent laws?
I meant when you are trying to go out with a woman over the legal age obviously... If she's a minor then she's not fit to make that kind of decision by herself yet
Asker1 ySays who, the law? I agree with that.
Are YOU saying the law has nothing to do with relationships?
Asker1 yYou used the term "legal" which means you DO acknowledge that the law IS involved in relationships. So why are you lying and saying that it's not?
It’s fun when it’s revenge cheating. You hurt my platonic friend/one of my exes.
Not so platonic anymore.00 Reply
