While you're right about this as a technical matter of law, unless you're engaged in some kind of "lewd conduct" (sex act), it seems doubtful to me you'll be arrested. Worst that is likely to happen is that a cop will tell you to put a top on.
If you think it is likely you will be arrested, say you are doing it as a form of protest, perhaps against the public indecency laws. Then it becomes a matter of first amendment free speech. Your case will likely be dismissed.
