I prefer the death sentence to cruel and unusual punishment. However, I would be opposed to either punishment based on the following definitions of rape:
(1) It is rape if an 18-year-old boyfriend has sex with his 17-year-old girlfriend.
(2) It is rape if she says, "I have to go home now" and the guy doesn't immediately stop. ***
(3) It is rape if a guy buys or gives her an alcoholic drink.
(4) It is rape if after the fact she changes her mind.
(5) It is rape if the guy is persistent, the girl didn't want to, but gave in because she didn't want to upset the guy.

Yes but they also need to be seperated from normal society. I watched a show about pedophile priests and one guy knew it was wrong and hated himself for having bad thoughts and decided to cut off his penis and testicles. The result was it didn't change his feelings at all and because he had no way to masterbate his urges became worst. Whatever the punishment is for rapists, it should be the same for those who falsely accuse someone of rape. It is a much more common crime that most people realize, and equally devastating to the victim.
