The doctrine of "innocent until proven guilty" means that a lot of guilty rapists getting away with it is preferable to innocent people getting punished. I, for one, agree, but most people don't- not beyond a very narrow point, anyway.
Consider Emmett Till. If you don't know, Emmett Till was a young black adolescent from Chicago who went to visit some family down in Mississippi. While in a local grocery store, Till supposedly starting flirting with (or whistling at) the white proprietress. A few days later, a group of armed men came to the house of Till's relatives and abducted him. He was beaten, mutilated, and shot through the head for the crime of flirting with a white woman. He was fourteen years old.
This was viewed as an example of the heinous racism running rampant through the American South at the time (which it totally was), but was also a sign of the dangers of reaction on emotion to accusations of terrible crimes. (Five decades later, Carolyn Bryant- the woman who had accused Till- said she'd made it up.) Did the country learn from that? Look at the confirmation hearings for Supreme Court justice Kavanaugh. During the hearings, he demonstrated a disturbing lack of knowledge of how many aspects of jurisprudence work in the US (sorry for the US-centric nature of this reply; I only know what I know), probably more than enough to disqualify him- and that's coming from me, a person with no background in law whatsoever.
But then a college classmate of his came forward and accused him of raping her at a party thirty years earlier. The case she made was shaky as hell, the witnesses she brought forward contradicted her, her story had more holes than Swiss cheese, and *still* she nearly succeeded in getting his appointment rejected. When it was approved, I actually found myself cheering "Thank goodness that horribly unqualified boob got this vitally important job!", I think those were my exact words. The Democrat lobby was extremely upset that this tactic failed to work, which is part of the reason I'm so scared of them. We saw what happens when an unfounded accusation with absolutely no proof is taken as a guilty verdict. If you've forgotten, I'm sure Emmet Till would be happy to tell you.00 Reply

She still told everyone my cousin raped her, when he didn't. Luckily most people didn't believe her as she couldn't even get his name or age right.
The second guy was a boy she fancied and her friend was dating him and not her, ending in a break up and him being kicked out of his band.
The third guy actually got sent to court and she got found out for lying because in the sex type apparently she was the one pushing herself on him and consenting. She was just angry he dumped her.
I don't know why everytime things didn't go her way she thought falsely accusing innocent teenage boys of rape, some who were still virgins. She thought it was perfectly okay to try and ruin peoples life and reputation and then play victim whilst wasting tax payers money so she could go court and be found out a compulsive liar.

These things right here, false accusations. It really gets on my nerves. Just like this teen who was made a suspect by the police after his sister's death; they thought he killed his sister because he was being distant. He was later removed from the suspect list.
I don't want to be in his shoes when he turned out to be a suspect.
Other than this, if someone gets locked up for false accusations, I want to help their family members and friends to find evidence that they didn't commit anything. Yet again, I don't need to be in others' business.

Honestly, there are so many men in jail because a woman lied. We know they lie because men lie too. People suck, and everyone doing something wrong lies. Unfortunately, that's all their doing is lying, even though it can destroy a man's life forever. People forget about the women, but no one forgets what men have been accused of in the past. As a man, I'd like to see some equality here and send some of those female offenders to jail. But, you can't hold someone in jail very long for lying. Should that change? ... +1 yNo. For a moment, I agreed, but thinking on it more, I believe it would discourage women who actually were raped for coming forward about. Even now, many women who are victims of rape remain silent because they don't believe that coming forward will actually do anything or would make their situation worse. We don't need an added layer of dissuasion. A good lawyer can make even a claim of an event that actually happened seem like it didn't. There's too much potential for things to go wrong for me to support the idea of being punished for a rape allegation.

I'm not going to provide links because I've seen how ugly these types of topics get and I am not going to get into a battle with people arguing credibility. I am discerning, myself. This person passed my criteria for credibility, and that spanned several years that I followed them. But I do not know any further particulars of the statistic.
Rape cases brought to the state are rigorously investigated. Most are thrown out before ever going to trial, because of lack of physical evidence. (Many women are so traumatized they don't go to the authorities within the timeframe to run the physical exam and tests.) This means the prosecution rate is far lower than the crime rate. Yes, false claims could, perhaps, be higher than 1-4% which are proved, but only the rock solid cases go to trial, all others being dropped, letting off both the accuser and accused. - +1 y

And upwards of 90% of all the prisoners are men and you know why? Largely due to false accusations put against them made by women. Those that make false accusations need to get the exact punishment as the false accused would have gotten. The problem is that proving the allegations are false is hard. If someone really believes they were raped, then it's not really false. They'd basically have to admit that they lied. I would require a false accuser to give a public statement acknowledging their lie or face jail time. The only problem without absolute evidence, (like a video of either party at the time of claimed incident or other irrefutable evidence), the verdict could be separated by limited evidence. It would be horrible for an actual victim to be forced like that, so it has to be irrefutable to have this outcome. Most evidence won't be irrefutable, so you'll have a court determine it false, but in reality it could still have happened. If you know for a fact the person was lying or they admit it, then yes, but that isn't always possible.

Rape, while not as objectively as bad as child molestation, is a extremely serious offense to both men and women and when accused and/or convicted of it is extremely damaging to their reputation and any kind of future career that they desire. If you genuinely thought someone raped you and they didn't, then legally you are guilty of false accusation under mens rea via recklessness and negligence over wrongful prosecution.
Literally every other type of criminal accusation works the same way. It's the same principle of why countersuits against Frivolous litigation is a thing, because if it wasn't then then there'd be no deterrent for abusing the justice system using Frivolous litigations. And that's one of the reasons false rape accusation is surprisingly high compared to other types of crimes, because currently there is no deterrent for it.

If you've taken even criminal justice 101then you would know that the court does not prove anyone innocent in criminal trials. Its either guilty or not guilty. Not guilty, meaning not enough evidence to convict, is not necessarily innocence or a 180° flip on the prosecution.
Allegations of rape aren't civil suits where one side wins and the other loses. If reparations for slander are sought, the civil court will decide that. Rape is a felony, and felonies are brought forward by the state, not the woman or man claiming to have been raped.
Imagine if every criminal proceeding ran the risk of backfiring and imprisoning the person who came forward, people who have been abused are already often times afraid to come forward, if you had it your way rape would never get reported.

If you are mostly sure someone raped you and they didn't, if you accuse them you are harming an innocent, whether their reputation, their bank account, or even the possibility they'll slip through the crack and go to jail (a sizable percentage do)... in that instance you have serious harmed someone who is innocent. Unless you want to plead insanity, that is criminal recklessness and negligence.

@ThisIsMyOpinion As a general rule, statistically about 85% of reported rape accusations are inconclusive and could either be true or false, with about 10% being conclusively true and about 5% being conclusively false. That makes 1/3 of rape accusations that are proven one way or the other false.
That is a very high percentage compared to other crimes, so the idea that the rest of that 85% are all rapists that got away and none of them were false, is pretty unlikely. And that same logic applies to the unreported hearsay. "Victim blaming" is just another way of saying "i don't believe you with good reason". If we're going to just automatically label an "accuser" a "victim", and the "accused" a "perpetrator who was never charged or got away", then what exactly is the point of even having a justice system?
We may as well go back to lynch mobs and witch trials.
And no, I don't think all rapes are reported. In fact I'd guess there's a fair number that aren't, and if I gave the biological reason for why, feminists would probably hang me. However, just because I think it makes sense why that'd be the case, I'm not going to state it's a fact that it is, because it isn't a fact, it's an unprovable theory. @ThisIsMyOpinion nope, it was very much doctored data, because they kept changed their mythology repeatedly when it wasn't giving them the results they wanted. To the point they eventually classified women who answered no to "have you been raped", and yes to "have you ever had sex under the influence of drugs or alcohol", as rape victims. And even after that they had to reclassify the definition of female on male rape as not rape, but rather sexual assault, because their own data showed gender parity.

You know nothing about false rape allegations and how much they damage men if you think the punishment doesn't fit the crime. They're often equally destructive, especially if they're made public. Rape also happens to both genders, while false rape allegations happen almost exclusively to men.

@MCheetah I can say you know nothing about rape or sexual abuse if you think someone deserves equal treatment for a crime as big as rape. That should all be dealt with as a separate crime, it shouldn't be linked in with what the victim would have had to go through.

Apparently YOU don't know rape happens to both genders, based on what you implied. Furthermore, if you're saying how rape is such a big deal, then how can you undermine that by saying women should (continue to) get away with lying about it and serve literally NO consequences for it? You are undermining your own argument by implying rape isn't a big enough deal to the victims of it that people who lie about it (99% of those being women) shouldn't have any kind of punishment more than a parking ticket, while also implying it's a major crime. Your logic makes no sense, unless you want double standards.

She should go to jail as long as the rapist went because thats how much time of his life she wasted. So the punishment does fit the crime. If a lying whore sends a dude for 10 years in jail then she should get 10 years.

In my original answer I was against someone doing the same time the convicted person would have done IF they had been found innocent before hand. Meaning no one in this scenario has actually been sentenced yet.
If someone was falsely convicted and went to jail for some time, I don't see a problem with the accuser getting the same time if there's solid evidence they lied. - +1 y

People rightly so say they will ALWAYS believe the victim as they'd rather believe a liar than a rapist, which means if someone falsely accuses a somebody of rape, that person's life will be ruined. People will disassociate themselves from them, and possibly prevent them from future careers or relationships. Surely that deserves punishment? If somebody was to lie about any personal crime (rape, murder, etc). a punishment or deterrent is needed!

Of course, but just like rape accusations themselves, a lot of cases get thrown out for lack of evidence. It can be hard to prove that a person was making a malicious false accusation just like it can be hard to prove that sex wasn't consensual.

+1 yIf a woman is found guilty of a false rape accusation, she should serve a sentence equal to AT LEAST half of what the man would have served, had he been falsely convicted. PLUS, she should pay his legal fees and reparations.

+1 yA lot of rapists don't go to prison because often rape is hard to prove. So, only an actively proven to be deliberately false accusation should have legal consequences.

i didn't say they should have special treatment or that they shouldn't be punished for doing such a crime. I just dont think cooping them up in a cell for who knows how long will make them realise the effect of their accusations on the accused. There is no guarantee that they won't repeat it again. The whole reason punishment exists is to make them realise the weight of their actions and make sure they dont repeat it again.

And on what u said, i think its the same for most people who do crimes, even males. Men and women alike have their own egos and cockiness thats infuriating to watch. There was famous case where a woman accused a African American man of rape and he was in jail for 10+ years. With the help of NGO and a trusted lawyer, they set up a situation where they brought the woman again to meet with the man and she admitted she falsely accused him and they caught it on tape. I think you might have come across it. She later said some excuse to try to cover herself up but she was punished later.

Going to jail or prison is 10% about correction and 90% about retribution. Society doesn't care if she gets anything from it or not.
