I feel if rape is 100% proven they should be given full life sentence.
I also think if a fake rape accusation is 100% proven they should also be given a full life sentence.
To me a fake rape allegation is just as harmful as rape.
This person accused will be traumatized and afraid to have a normal sexual relationship or even a relationship with anybody out of fear of it happening again.
Not to mention usually it makes the papers, and no matter how much proof clears the person, they will always been thought of as a rapist because most people take the first impression they have of someone. Which in this case is they are a rapist.
People will always wonder did they pay off the person or intimidate the person or get lucky to not go to jail.

+1 yYes, they should do at least 5 years, why? Because they're trying to ruin someone's life by lying, so they need theirs ruined. It should be a felony and they should be working twice as hard to get housed and a job just like a man who's falsely accused would be. Depending on the ages, they should have to file as an offender if the guy was charged with those charges... An eye for an eye.

+1 yMakes you wonder why they even admitted to it, if they didn't like the guy they had no reason to ever admit it.
Punishing them means people will be less likely to ever admit it, knowing full well they could go to jail so they make it and never admit it.
Then again, there is actual victims that get terrorized by the friends, family of the rapist and even police, to recant or else. They get threatened you have to or I'll kill you, or your family will be killed or you'll go to jail.
A rape victim who was just violated has no reason to doubt that they aren't serious after what just happened.
Thus forcing true victims to recant and say it was consensual or never happened to try and make it end for them. After all that often feels like a safer way to just make it go all away.
Seems like sending an actual victim to prison on top of being raped is a bad way to go.
Recantation is part of the "rape trauma syndrome" as they don't want to face them in court and they just want to act like it never happened to move on.

However if it can be proved without a doubt someone filed a false police report, they should be charged with that at least, class A misdemeanor. The reason I say only that, is because victims are less likely to file a report in the first place (there is already estimated that only 1 in 3 file to begin with) that people would be less likely to file.
Imagine being a rape victim and the attacker was someone who not only had power over you and your body but potentially has the ability to flip it around on you and claim it was consensual or never happened and they believe them over you. Now you get charged with it and go to prison for years.
What really needs to happen is how the system deals with crime. Not just rape but anyone suspected of any crime, should have their name withheld until conviction. As we know society assumes someone got arrested, thus they are guilty until they can prove in court that they aren't. Socially they are guilty, legally they are not.
Laws to keep the names hidden until conviction and anyone that leaks it, becomes a criminal too for leaking it.
Police also didn't need to take him out of school like that, could of picked him up at home, he would of gone there sooner or later.

If it can be proven that an allegation of rape is demonstrably false, especially if it was made with malicious intent, then the accuser should be forced to undergo at least the minimum punishment that such a conviction would have held for the accused.
This includes registration as a sex offender, because if she was willing to ruin his life, by forcing him to register, then she should be registered as well, so that future potential partners will know to avoid her.
This will also serve the dual purpose of making future, legitimate rape claims more believable, and potentially decreasing the chances that a legitimate victim will be criticized for what they suffered.

Don't misunderstand me. Rape is perhaps the most heinous act one person can do to another. I have two very close friends who were raped. I've seen the devastating impact it can have.
I've also counselled a man who was falsely accused. He lost his job, his fiancée left him, his landlord evicted him. It took years after his accuser was jailed before he started to get his life back. And that was before the internet.

They should also have to register as a false accuser to prevent them from messing over someone else in the future. Then they should have to pay for any monetary damages the accused suffered such as losing their job or being denied a job for the accusation.
In my experience and what I have personally witnessed in the real world there is often no punishment at all for a proven false accuser.

If we just toss the accuser in prison for however long the accuser would've gotten, what on Earth is going to motivate a false accuser to come forward and admit it? I agree this is a serious issue, but if protecting the innocent is more important than punishing the guilty, we need to find a better way.

Anonymous(36-45)+1 yIf they admit to making a false allegations it should be 5 years mininmum maybe more if the accused had to do time, however it should be that they admitted to making a false allegation, many times actual rape can't be proven, especially if a women didn't consent but decided to make things easier on herself by not resisting and have less injuries that way. In those cases guilt can't always be proven but I don't think that means charges shouldn't be filed, the attacker is still a dangerous person.

If not you should have to do community service. Maybe work at a shelter or something. Maybe being humbled a little bit will make you realize it's wrong to think you're that much better than everyone else.

00 ReplyI think that in theory that that is a good idea. But practically, it would be near impossible. First there would have to be a determination / trial for whether the allegation was true or not. Then there would have to be a determination if there were enough evidence to pursue charges against the accuser. Then there would have to be a trial that could find that the accuser is guilty of making the false charge. That series of events I find highly unlikely.

+1 yI don’t think jail would help. Just puts the burden of punishment on the tax payers.
They should have to pay for damages minimum of $70,000 that would be taken out of there tax return until paid plus a minimum to avoid jail time, report as a sex offender to all there neighbors not to exceed 10 years.
But honestly I wonder how many would come forward for lying if we punished them it means they would likely rather ruin someone else’s life rather than there own. Anonymous(36-45)+1 yIn both situations, sex is being used to demean, humiliate, overpower and ruin a life. The effects are the same, with the exception that a convicted rapist in prison (whether he committed the crime or not) will be beaten and raped repeatedly. A female false accuser won't be. So a false accusation could be considered worse.
Women live to crow about how a rapist will "get his" in jail. Maybe we should send the false accusers to take his place in the same jail, same cell.
