I am not sure what you mean, but the killing of another person by negligence that does not rise to the level of an intentional act is called manslaughter.

Rape is NEVER justifiable. Theft can be justified when someone needs to eat and cannot afford food. Killing (not murder) is justifiable in the case of self-defense. There are many crimes that are justifiable and are only crimes because society says so. Many crimes should not technically be crimes because they reflect societal values instead of real threats. Rape is not one of them. Rape is overpowering and hurting someone for no good reason. Rape is not essential to survival. Rape is just someone pushing their will onto someone else at the victim's expense.

I would think if it happened once it could happen again. I don't agree with it, but I can present it as a possibility.
