I think that someone who accuses an innocent person of rape should be handed the same sentenced the accused would have received. Both are incredibly despicable acts.
Well video aside, you do realize that there is no way for a man to prove he did not rape a women when she claims he did. She can go to the cops, fill a report and they will say it may or may not be a prosecutable... classic he said she said. Even when he is not arrested, or even charged or even investigated there is literally nothing the guy can do about his reputation and the slander being used against him. You can not sue her because you can't prove its slander, and cops will just say there is no evidence to support her claims... but she still insists that she was raped and the man has no way to prove he didn't.
Happened to me trust me, was married 22 years... wife was stealing from me. We filed for divorce, and she even said in her initial filing that there was no claims of domestic abuse. When I cut off the finical support and went after custody of my daughter, she files a rape charge against in May, for a marital rape she claims happened in January... five months later. My daughter believed her... the rape case was dismissed but she got 100% custody of the kid and full child support.
Nobody believed her, I mean no body... but there she was on Face Book talking about "Me To" and how women are so discriminated against. UNFUCKING Believable, I was a huge promotor of equal treatment I heard all these stories and thought it was conservative mansplaining bullshit... but never believed that someone or something like that would happen to me. That's a tough question. It would essentially involve two trials. The first one would be where the accused is on trial. Being found "not guilty" is not the same thing as being found "innocent". If the accused were found "not guilty", then the question would be whether there is enough evidence to bring a case against the accuser. If the accuser were found "guilty" of a false accusation of rape, then they should definitely face some severe punishment. I don't know if it should be the same penalty as the accused would have received if they had been found guilty. But I think that's something to consider. I know people are already jumping out of their seats saying that this is going to scare people into not reporting actual instances of rape. But there would be three hurdles that would need to be overcome before the accuser would be in any legal peril. First, the accused would need to be acquitted. Second, prosecutor would have to be convinced that there's enough evidence to bring charges against the accuser. And third, the accuser would have to be found guilty, beyond a reasonable doubt, of this false accusation. To prove that the accusation was false, would be essentially the same thing as proving that the accused is "innocent". Again, "not guilty" and "innocent" are two entirely different things. If all of those three hurdles were overcome, then I could be convinced into having the penalty for such thing being equal. But I'm not 100% convinced of this idea and I'm more than willing to listen to what others have to say.

Unfortunately the justice system is fucked and so many reports of rape don't go any further than a report, I'd know myself, my ex raped me, admitted to it twice and I went through two years just to be told "we can't do anything because he thought he had consent" so what, rape is okay as long as I think I have conset?
Also the number of rapes and sexual assaults which are never reported or prosecuted far outweighs the number of people convicted of rape because of fake accusations. A lot of people keep quiet about it even though it's happened to them, I've been raped by one man, sexually assaulted by two and raped by a woman, only the one was reported because I knew it was useless trying again.

I don't think anyone charged of any crime at all, should have that publicly announced by law enforcement, until after a conviction. This goes for any crime, rape, and mass shooters for example. NO name given on the shooter until a conviction is achieved, meaning they get no press or fame from it until a year or so down the road and then the fame is, your going away.
It isn't just a accusation of rape, any criminal accusation will hurt or ruin someone's life. We should all have a right to privacy until the conviction happens.

I know that accusations ruin lives, but at the same time, many true rape victims will be pressured into recanting and then everyone says it was false, even though it really happened. Then those victims should be charged and get the same time as if the person who actually raped them would of gotten.

The issue is there is no way to handle this in which all rapists go to jail and all false accusers go to jail and all innocent people are not severely harmed. So which group will be most screwed basically? Historically the legal process has been erred on the side of the innocent accused. Better to let 10 guilty men go than let 1 innocent man go to jail. This is why there is so much push back on rape specifically when there is no evidence except the accusers testimony. Also there is a reason why people are publicly charged and arrested because historically when this was not done, many countries had and do still have abuses where they would disappear people in the night for who knows what reason or how long or why. I commented on another post at somepoint that we are in a culture of sexual freedoms, where a hypothetical scenario a woman consents to a list of 100 men for a gangbang. Some guy walks by and sees a line and joins in. The woman enthusiastically does her business with him. At the end does she realize it was 101 men. She the accuses rape and expects that one man found and severely punished. What kind of harm has she experienced? Has she been robbed of something? What if she doesn't even notice until 10 years later? Alternatively another woman is a virgin waiting until marriage, a man grabs her off the street with a gun ties her up and rapes her. Now her fiance and her have problems and they end up breaking up. She ends up with ptsd and never wants to be with a man ever. Has she experienced harm like the first woman? Is it the same crime? Are both even crimes? Should they be punished the same way? These are the things our society is having problems with because i think clearly these are two ends of a spectrum many people try to mush into a single category of rape. To most people this is incoherent. They experienced or heard of one side of this spectrum and either they then say ahh accusers are usually liars and ridiculous, if i short change a prostitute $5 on her fee thats a joke that its rape. While on the other hand many would say death penalty for rapists for people with the other scenario in mind. Our society is so split its hard to even discuss what is rape and whats not.

You can move away and start over fresh, if there was a not guilty and people don't know who you are. I've seen it done, but there is only between 2% to 6% of actual reported rapes are lies and didn't happen. The vast majority are real.

However I watched her testimony. Personally I believe that she believes what she is saying. But she had no witnesses, no evidence and over 30 years have passed. Your memory is not a video recorder unfortunately. It can be manipulated over time. I think this was most likely a mistaken identity or a gross exaggeration of the incident. But I do believe she believed her story. Doesn’t mean it happened though.

The whole 'false accusations are very rare' trope is kinda hard to defend anymore. We hear about it occurring all the time, in our personal lives, across the internet and on college campuses. During a conversation with two guys and a girl I know, it turned out we each knew a guy who was falsely accused of rape or some sort of sexual assault. Then the girl says these cases are very rare and I was dumbfounded. I was like 'yup, they're so rare all four of us know someone it happened to. What are the chances of that?'. It's not rare, and it's only getting worse. In the past three years lawyers specializing in false accusations of such crimes has tripled, at least in the US. Lawyers specialize in what the market dictates. Why do you think there are so many divorce lawyers? I can name ten college cases where men were falsely accused here and in the UK. And until there is some sort of legal deterrent for, y'know, committing perjury, filing a false report or just wasting a bunch of peoples' time, it'll continue.
Then there's the everchanging definitions of sexual assault, harassment and even rape. The woman in the video is crying rape and it's obviously not. A few years ago in the UK some group polled a bunch of women I believe between the ages of like 14 and 38 - apparently 92% of them said they've been sexually harassed. That was until they scrutinized what the poll was allowing as harassment (staring, unwanted approach/conversation, saying hello... really?) and it dropped down to 86%. Naturally there was no poll asking as many men if they've been sexually harassed. Probably 'cuz any number close to 86% would've undermined their whole victimhood angle. Plus as men we're intrinsically supposed to like it or something. And whose doing all the accusing? Not men. Not by a longshot. And since men aren't (falsely) accusing women of rape, women will never know what it feels like to be in that predicament. Men, however, can and are raped by both genders. So in actuality, men aren't alien to the aftereffects of rape.

I´m not sure if one can really weigh the emotional consequences of rape against each other. Bot from a guy´s perspective you´re life is over if you´re accused of rape no matter if you´re guilty or innocent because no one will believe you that you didn´t do anyways. All will say it´s not been proven but that doesn´t make you innocent.
On the other hand the feeling of being raped is surely devasting because who can you trust if you actually trusted the person that raped you?

@MCheetah I just speak from my own experience, and someone I know’s experience with being falsely accused. The kid ended up committing suicide because of a false accusation. Both rape and false accusations can destroy someone… It’s only fair to say that they are both horrible crimes.
Some of the reasons why they lie about it are so unbelievably petty too. Needed an excuse for missing curfew, to make boyfriend/boy she likes jealous, simple attention, he turned down an offer for sex or rejected her advances, an excuse to do bad on a test she forgot to study for, unsatisfied sexual result, he was rude, revenge, and my favorite, as a gag. As a man I live in semi fear of a fake rape accusation, it doesn't take a lot to have your entire life ruined, even if not charged with the crime, just the pure accusation alone will have everybody questioning whether you really did do it.
People lose their jobs, reputation, marriages and homes over things like this, it will hang over their head for the rest of their life.
It also takes away from the real rape victims with legitimate valid accusations, with too many false accusations out there being exposed, many women may not feel inclined to to make the accusation in fear of not being taken seriously.
While I don't think false accusation should carry the same sentence as rape it should definitely carry a very similar sentence.
Just imagine what would happen if a woman falsely accused someone of rape, and was found out, then some years later she really was raped, how well is that going to end for her.

I would say rape is still a more damaging thing to be subjected to but the people who cry rape when it's a complete fabrication are really terrible people, as the stigma of that can, quite rightly, stay with someone for life.
It's also why with rape cases it is best that it is dealt with some sensitivity and care and should not be so publicly aired, at least until their is something that can actually be substantiated.
It's a really difficult question but I think the reality is there are very very very few women who cry rape without some genuine cause!

I think ACTUAL legitimate rape (not "eye rape," drunken consensual sex, or MeToo bullsh*t), is the worst thing. So to answer your question, no, it is not 100% equal to rape. HOWEVER, rape accusations should be treated almost as seriously as rape itself, as the accusation alone can and has ruined men's lives before.
So I'd say the accusation of rape is maybe 80% as bad as rape itself, with the difference being harm to your reputation and standing as a person, where as rape does mostly psychological and potentially physical harm, to the person. False rape accusers who are proven to be liars should have to do 80% the prison time the accused would've gotten for the crime if it was real. The harm to someone's reputation, mindset, and employability should not be discounted simply because it is not as physical of damage to someone.
In short, both are very bad and should not be condoned.

Pain, suffering, are qualitative and cannot be compared like numbers. Rape is a terrible thing to happen and leaves permanent physiological and physical marks. Accusation of rape leads to loss of reputation, livelihood, and distress and in case of conviction on false accusation can lead to worse eg. physical abuse and at times even death because rapists along with ChoMos are seen as the absolute low in the prison hierarchy.
False accusation, or trivializing rape does another thing, it reduces the credibility of genuine victims. So the majority has to suffer for the selfish goals of a few. Accusation was that it was consensual at first, she took consent away in the middle of sex, that I pinned her down, she fought me off, started riding me, gave me head, and that I fingered her against her will (while she was showing me how to finger her). There was a sex tape. I got charged. I did 18 months because of how high bail was and covid kept pushing my trial back. I was found completely innocent. She wasn't charged with anything, I wasn't financially reimbursed. Nothing. And retaliation is illegal.
I won't put them on a scale. Saying one is worse diminishes the other. In my career, I have dealt with the aftermath of both happening to others.
Rape is awful. The physical damage is horrible, but the emotional, mental and spiritual damage is far worse and often lasts a lifetime. The best a therapist can do in many cases is help them live with it.
False accusations of rape are also horrible. People have their entire lives destroyed. Careers ruined, marriages wrecked, reputations left in a shambles. People that were close to them will always think of them as a rapist, even if they can prove they are not. Those are often the people he was closest to before.
Emotionally, mentally and often financially they are destroyed with no way to build back again. That's if they don't go to prison.

I think it's very tough to say let's say something happened to you and you are you can say ok it was not my fault and can blame someone.
Most people get sympathy which is good and bad in its own way
Nobody has any compassion towards rapists for obvious reasons.
Now to live accustaion of something you not even did and to get punishment for that is also very soul hendreing process.
You can never come out of it and nobody would love you anymore.
Everyone will look you like criminal.

I think it's possibly worse. A woman can go back to her family and job. A man falsely accused of rape will be cancelled. His children won't even be able to return to school.
As far as criminal charges against women who make false accusations;
Yes, I believe they deserve a long prison sentence. However, that is a slippery slope and I'm not sure what the correct approach would be. Actual rape victims would fear being prosecuted for false claims.

I think they should have a fear of this because its been proven a certain type of woman will wait 10 years to make an accusation and typically those ones even if were raped remember it so wrong they remember a man with a huge beard and 7ft tall dressed in a suit. Then they find a video somehow and its a clean shaven 5ft tall construction worker. These kinds of women who do this should have to take a breath and say I've gone 10 years why am i going to bring this up now and how accurate is my recollection of this event? They need to be held responsible for accusing completely inaccurate things. This kind of thing has actually seen men behind bars get released when we find out the accuser is so out of touch with reality yet with no evidence gets a man in prison. Say i go to sell my car to John and john pulls out a gun and steals it from me. I wait 10 years and then accuse Mike of doing it. Mike I saw you i went to meet you mike it was you. Mike should sue me for defamation and libel etc and i should face a charge of false reporting even though my car was still stolen at gun point. I had a duty to say it was john or if i wasn't sure to say i wasn't sure. I would have failed in that duty and be responsible for the damages.
A false accusation can be, but in my opinion, being an actual rape victim is infinitely worse than being accused of committing the act. You can always move to a new area or country, and likely people won't know who you are and you can move on. Rape victims don't get that privilege. We're stuck with it for life.
Technically not but it deserves a similar punishment because the accusation was made with the intention of punishing the innocent party severely & also: false accusations throw all other rape allegations into question which is an egregious consequence.
