To start, the Constitution stipulates, under the 10th Amendment, that any power not specifically granted to the Federal government is reserved to the states "or to the people." The latter provision typically being interpreted as meaning local government. To be sure, Federal authority has been read somewhat broadly in the 20th and 21st centuries, with some implied powers being read into the general provision.
That said, as an historical matter, health regulations in general have been under the jurisdiction of state and local government. Most health laws being state or local in origin. The only exceptions have been cases of interstate commerce as well as the authority of the Federal government over Federal employees and indirectly those entities that contract with the Federal government. Plus, more recently, to a limited extent, for the beneficiaries of Medicare and Medicaid.
(Also, it should be added that the approval of all drugs - including vaccines - for sale and distribution, is in the hands of the Federal government. This deriving again from the Federal government's power to regulate interstate commerce.)
This is why the President, in announcing his "mandate" is attempting to impose it through OSHA health regulations. That is that he is attempting to impose the mandate via the authority of the Federal government to maintain workplace safety - this power too being implicit in the Federal government's authority to regulate interstate commerce.
Thus also why the Administration is imposing the mandate only on those companies with 100 or more employees. Assuming that smaller companies will be, on average, less likely to engage in interstate commerce.
Suffice to say, the Biden Administration, in attempting to impose a vaccine mandate is, at the very least, attempting to thread the constitutional needle. At the most basic level, the President would seem to be, prima facie, exceeding the authority of the Executive branch. However, there is enough room for interpretation such that the case will have to be argued in the courts.
As far as the likely outcome of such a case is concerned, at the level of the Supreme Court the tendency of the Court, historically speaking, has been to give deference to the elected branches. However, as the President has made the penalty for failing to comply with the mandate the potential loss of employment, that will likely be viewed as going too far. Consequently, it is more likely than not that the President's mandate will be, at the end of a fairly lengthy process, struck down.33 Reply- +1 y

By the way, taking a stab at this, the ACA mandate was a question of health care coverage and financial obligation. The penalty was financial and not one related to employment.
As I noted above, this makes it different not just in degree, but in kind. Had the Biden Administration sought to impose a financial penalty - such as a fine - they would likely be on firmer ground.

Yes and in medicine you troubleshoot based on the last thing that changed in the body. Which, if were an experimental vaccine with largely unknown side effects in young people, pregnant women, in the medium and long term is a pretty big red flag.
This argument is rather invalidated when you consider the other Reporting systems for the UK and EU are showing the same trends and if you read the reports they largely all have to do with blood clots which is a known issue caused by the Spike Protein. The vaccine doesn't prevent cases 100% of the time. No vaccine does. Covid vaccines about about 80% effective at preventing someone being infected. If you do get infected which obviously happens then you are far less likely to have severe symptoms and need hospitalization.
In the usa you have if I remember correctly a 1 in 8 chance been infected with COVID-19 if you are unvaccinated and 1 in about 10k chance of being infected if you are vaccinated.

You're out of date. It is well known that the vaccines lose efficacy within months and may peak at 80% but that rapidly falls away.
To the second point you're using a useless metric. At 40 cycles or higher the PCR test can detect basically anything. The inventor literally said it could test you positive for anything. The important stats are hospitalization and death. Most people who test positive never knew they had it because the test is throwing false positives because its finding remnants of dead virus.

I have no idea what your deal is. But you had better stop listening to Glenn Beck and read the actual Constitution. Mandates are for local jurisdictions. They can be created on that basis only. The Federal Government issues what is known as "GUIDANCE". It says,"look you can do what you want, but we recommend this". You and certain folks on this page are posting lies. Because you are claiming that Biden single handedly without any input or bill submitted from Congress, decided to create an Executive Order to force mandates. That is a lie.
He can't. He knows he can't. But he can make all the suggestions he wishes. He is the President. You can disagree with those suggestions. You can call him an idiot or whatever. But when ever people lie about Covid on this page, I will confront them. Because people are dying. This is serious business. This is not about your politics.

@HollyK21 Well I am sorry. I am not chilling out anything, I am very serious. So while you "chill", I am focusing on preparing what I have to do for my life. Why would anybody want to wish death on anybody? People have choices to take that vaccine or not. But either way, they are still trying to harm people and they know about it. I will not force my opinions, etc on anybody. And nobody is forcing me to get that vaccine. Period. I encourage people to do their own research on it, look at the things they are too afraid to look at. I have watched more than half of this mainstream news and even news on youtube. It really isn't hard to see and hear the lies coming from that. Again, people have choices. I was never part of this world anyway. I have broken no social contract of anything. So if people want to be in systematic slavery, that again is their choice. People are growing cold and inhuman and some have reported of behavioral changes also.

If I ever had casual sex it was because that was the only thing I had access to, for a long time, versus dating horrible girls, people that nobody wants to deal with. I would change that for a decent relationship anytime!

My country isn't a Muslim country, and when I had sex with someone it was most of the time because I guessed we would be into a relationship very shortly.
But that never happened, the girls just vanished. After this happened like ten times to me I just got tired and had casual sex for a while, yeah. But then I stopped again, because it felt like nonsense.
My mistake wasn't to have casual sex. My mistake was assuming that these girls were as ethical and serious as I was, without proof of that. Hence these days I fuck with no girl till I know them very well, and they are serious by demonstration. In case of doubt I ditch them.

Firstly, I didn't judge when I didn't. I had said you came from Muslim country did you not put it all you had to do was clarify you don't come from a Muslim country. Know your mistake was all those things. Your mistakes was you assuming that having casual sex with how you get a relationship and your mistake was having casual sex when you can not handle it be responsible let alone accountable for your decisions. Those were your sexual decisions and it didn't matter if the girls were bad or they were still at the end of the day your decisions. You knew what you was getting into when you made those decisions. Especially if you was taught to wait until marriage to have sex so if you chose to forgo that for something cheap and easy to get then look at what you chose to do. You made those decisions you cannot blame these girls for Vanishing when they already knew what the intent was the intent was just to use you for sex and it wasn't looking for anything else. You don't want to be responsible for how you truly feel and what you truly want.
