No and yes, respectively. This isn't treason, it's just incompetence. Treason, under US law, consists exclusively of "... levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.".

Actively undermining the Constitution? Oh, that counts- especially in this era of the War on Terror (you didn't think that had gone away, did you?). But that would require arresting a good third of Congress for voting for the Patriot Act, so it ain't gonna happen.
