Hard to know. If Garland is serious about enforcing the law without fear or favor, yes. But i dont think that he can be a serious about that as he might be imagining. Maybe 99% of the Republican politicians and probably a substantial number of Democratic politicians would have prison time looming if he did that.

Practically, what prison would be appropriate for a former President? Maybe house arrest but any prison he'd be in would be a fiasco... remember that Secret Service would have to provide protection for him in prison.

It's unlikely he'll be found guilty of any crime... maybe slapped on the hand about how he handled documents, and all of the seized documents will go to the National Archives, where they should be.

A century ago, Trump would have been hung for high treason, but he and his enablers have run out delay tactics and excuses, so Trump will be off to prison. I don't think it will be long prison time, because he'll probably have some mysterious death like Epstein or Ken Lay.

There's neutralizing the various security units around Washington DC by appointing his own people as managers of these agencies just months before Jan 6th, then having his loyalists come on down to DC, so he can rile them up, have them bust into the Capitol building with minimal security to stop this process, in an attempt to disrupt the election verification process, while he sits back and enjoys it on TV. Lives were lost over this.

Then there's the taking of classified material for his own personal use and storing this material in a non-secure location. That's a breech of security. Any clever foreign agent could get a look at this.

Then you have military aid approved by Congress for Ukraine, that Mr Trump decided to hold hostage so that he could do a Quid Pro Quo with Ukraine in exchange for dirt on his political opponent, Joe Biden.

There are other things, but those are the three big ones.

Lol!! Hilary was hardly "exonerated". She was without question guilty of mishandling classified material and having it illegally. The conclusion corrupt Comey came to, was prosecutors would decide not to indict because apparently she is to fucking stupid to know any better. Which I can believe. The purpose of the search was to secure documents that belong to the government. Trump had 18 months to return them without consequences, but he lied and obstructed justice instead.

It's not like he can claim not to know the consequences, he personally signed the bill that strengthened the penalty for mishandling classified documents to five years in prison into law in 2018.

No. The problem is a decision by the Supreme Court in 1987 that said, in effect, that a sitting President can declassify anything he wants however he wants. Trump claims he declassified everything he had. Because of that decision it is impossible to prove otherwise. Even if he were convicted, it would be tossed out once it inevitably reached the Supreme Court.

One each, I think. The Clinton one would never have been prosecuted if he were a normal citizen, it had nothing to do with the real-estate investigation. Trump was the co-conspirator with Michael Cohen with the hush payment, the various obstruction of justice counts in the Mueller investigation (crowned by Barr's obstruction on his behalf), the mishandled documents (which Trump made a felony in 2018), the Hatch Act, the emoluments clause, the Ukraine phone call, interfering in the Georgia election, just off the top of my head.
