Broadly, the answer is no.
Please note, the following I write as a Republican who has worked in politics for over 40 years and who is no fan of the former President. In fact, I did not vote for Mr. Trump in 2016, though I did - reluctantly - vote for him in 2020. This because I had long seen Mr. Biden as a Senator and had been, frankly, seriously unimpressed. Basically, the nation was trading a populist with a tendency to bombast for one with a tendency toward peevishness and petty corruption.
In any case, the recommendation of the House Select Committee on January 6th has no force of law. Indeed, it is problematic. As former Rep. Trey Gowdy recently put it, the FBI - which is supposed to enforce the law - is playing politics with Twitter while the Congress - which has no law enforcement authority - is making law enforcement recommendations to the Department of Justice. So much for the separation of powers.
In any event, the Congressional committee's recommendation was tainted from the outset. It was stacked with anti-Trump Democrats and, in a break with all precedent - when the GOP minority leadership offered its candidates for the committee, Speaker Pelosi vetoed them. Appointing in their place anti-Trump Republicans - see also Rep. Lynn Cheney of Wyoming.
The net result was a kangaroo court that was less interested in getting the facts - which one would have thought would have been damning enough - than in getting an intended outcome. It not being helped when the House Democrat leadership took the positive weird action of hiring a known Hollywood director to orchestrate the committee's hearings.
Suffice to say, the committee's hearings were predictable and had a bad habit of making mountains out of molehills. Such that even normally sympathetic television networks - see also CNN - did not really bother to cover the hearings nor the committee's other activities. The outcome was simply too predictable to be newsworthy.
The committee's recommendations, to be sure, will now go to the Department of Justice, which has been conducting its' own investigation of January 6. That is a DoJ that is currently under a Democrat administration and that, therefore, might have an incentive to prosecute.
Two problems with this. First, as a cold political calculation, Mr. Trump's popularity in the GOP has been on the decline. Now only about 34% of Republican voters want to see him run for re-election. Make Mr. Trump a martyr and that may change the poll numbers to the former President's advantage - with consequences that are, at best, difficult to assess for the Biden team.
More to the point, the case has been so tainted by obviously biased things like the House January 6 committee, that it is not impossible that a court would toss it out without so much as a "by your leave." If not in the first instance, than certainly on appeal. Thus suddenly Mr. Trump would be a hero - with VERY negative consequences for the Democrats.
The Biden administration will have to balance all of this out and they may go forward with a prosecution. However, that would be unprecedented in American history and would further divide an already divided country, with negative implications for Mr. Biden's already ten thumbed administration's ability to forge a governing consensus.
Bottom line, while not impossible, the consequences are unpredictable and the courts, if not the Administration, will likely not want to go there. This not to mention that, frankly, the direct evidence against Mr. Trump is pretty thin.
Yes, he should have called on the rioters to stop earlier than he did. Yes, it can even be argued that he egged them on. However, unless there is evidence of direct collusion - i. e., pre-planning of the riot and of Mr. Trump's direct involvement in that pre-planning - the case against the former President is pretty weak as a legal matter.
As a political matter, Mr. Trump has been a divisive and net negative figure in American politics, governance and history. However, that is a decision to be left to the ballot box - as it seemingly was in 2020 - not to a court of law.
Agreed, but an investigation by politicians…will be political. And Repubs were there embarrassing themselves defending the evidence they uncovered. And like every investigation, it uncovered illegality not initially targeted. So should the DOJ go after a former president for financial and election engineering crimes that were uncovered?
Meaning should the DOJ take that evidence and investigate themselves?
Well, as I mentioned, the DoJ probably will take up the case. They are already conducting their own investigation. The problem is that the case has been so tainted and politically loaded that no court is apt to give it a hearing. Likely it would be dismissed on procedural grounds.
There is a reason why criminal law has such extraordinary procedural protections surrounding it. In this January 6 case, the Congress ran roughshod over those grounds. Largely for the publicity the majority hoped - and failed - to generate.
DoJ may climb up that same hill, but they would be smarter not to. Mr. Trump is losing, especially after the mid-term election results - political ground. Making Mr. Trump a martyr for a case that is legally compromised and politically debatable would be unwise - and as I noted, apt to produce results the opposite of those that were intended.

You neglected to mention that Pelosi only vetoed GOP candidates for the committee because they were likely to be witnesses in the investigation. The GOP could still have proposed other candidates but declined to do so. It's unusual for you to gloss over material facts so I'm disappointed. Apparently partisan politics can blind anyone to basic facts.
@AngryCarl On the former I did mention it, though I did not go into detail for reasons of space. In any case, the GOP did offer a selection of nominees and were turned down. It is not likely that another round would have made much difference.
As to the latter point. I didn't say that the committee did not. I take that as a given. In fact, the committee did refer it and DoJ is looking into its' own investigation. That is not really at issue and I saw no need to mention it.
DoJ may prosecute. However, the courts will decide and DoJ is quite political. They have to decide if they have a reasonable chance of winning. As I noted, there are political implications to that decision and DoJ is, more likely than not, weighing those factors. Fair or not, it is not a decision devoid of political calculations and in a case of this type, the AG - and likely other senior administration officials - will be weighing those calculations in the balance.

Trump lost the election. It was proven then and though he has tried to convince others that he had won, every challenge he has posed has been proven wrong and in many cases made up by him. Many of his top political and legal advisors assured him he had lost. Knowing that he had lost, he tweeted "Statistically impossible to have lost the 2020 Election." Then "Big protest in D. C. on January 6th." And ""Be there, will be wild!" His own people recognized that he was intending the crowd, many of them groups that were stating they were going there to riot, such as the Oath Keepers, to storm the Capitol and wreak havoc. The rioters knocked down fences to get there and climbed the walls, then used everything at hand to break doors and windows to get in. Due to business being conducted inside, it was officially closed to the public, so Trump encouraged the crowd to break in and confront the police. The crowd had set up a gallows and were chanting hang Pence as they charged in. The police formed a secondary blockade inside to protect Pence, Pelosi, and others, and clearly aimed their weapons at the crowd through a window. When rioter Ashli Babbitt broke the window and climbed through, she was shot and killed. That was lethal force legally used to protect the lives of others.
Trump invited known violent groups to the capitol to participate in the riot. Even as those people were violently breaking into the Capitol, tearing down fences, using posts and flag poles to beat police (who had a right to protect themselves and could have started shooting at that point, but did not), and trampling others in the crowd, Trump was nearby, knowing what was happening, and encouraging more people to join the riot, and saying he would join them (he did not). It was only after more police arrived and the people inside who had been threatened were taken to safety that the crowd calmed down and many were leaving when Trump (from a long distance away) told the people to leave in peace.
Trump did not have the right to invite violent groups to the event, state that there would be a "wild" time, and encourage people to violently attack the police and congressional workers. He tried to go to the Capitol to stir it up more, but his Secret Service driver knew that was wrong and took him away, refusing to follow Trump's illegal orders.
As the crowd was trying to get to Pence, Trump was telling them that Pence was no longer a part of the good people. If Trump had had his way, Pence and Pelosi would likely be dead. Many Republicans who supported Trump up to that day have given sworn testimony to the committee that the defenders of the Capitol were acting properly and that the riot was an insurrection against democracy and America, and Trump should never serve in public office again!
Yes, he should be held accountable. I saw the entire happening on television while helping a daughter with her move. At first, Trump gave his speech about the "stolen" election, and then I heard him say that they should "fight like hell", because without it, there would be no country left, and the=at they shojld "take theor country back" (or something to that effect). He did incite these rioters, they took him both seriously and literally to go and "fight like hell" by marching up to, and climbing the walls of the capitol building; breaking windows, fighting with police officers, and breaking and entering a government building with the intention of causing harm to VP Pence, and taking the voting box which contained the actual votes from each state--which someone had picked up once they knew that the building had been invaded by these rioters. All along, Trump did nothing but sit in the living room of his office, and when called upon by his own children and his staff to make him stop the rioters, they were met by silence. He was in support of the rioters chanting "Hang Mike Pence":

“It’s common sense, Jon. It’s common sense that you’re supposed to protect,” Trump said. “How can you, if you know a vote is fraudulent, right, how can you pass on a fraudulent vote to Congress?”...
I was in awe watching this all unfold on television and could not believe my eyes. The fact that he called them "peaceful peopl " and "patriots" when 4 people died, is beyond me.
This is NOT a Republican or Dempcrate issue. It is an issue about OUR country and its' laws. No one should be allowed to take away the righting votes of the American people--and no one should be allowed to threaten our democracy. Had Trump succeeded in doing exactly what he wanted to do-- by stealing those votes and thus taking away our voices as to who we want to be our president--he would have succeeded in influencing our voting rights. Not only this--but by supporting those chanting to hang Mike Pence--it is a threat to human life.
I apologize for those typos because I am not a great typist--but I hope those who read itm understand my stance. Trump has done a ton of damage to the people of this country, and I think it is about time the courts do something about it. I can only imagine what could have happened as a result of his tyranny.

He is also the only person who has ever been on the FBI’s Top 10 most wanted list, and was quietly removed without explanation! He has never even been charged! Trump has clearly violated many laws to the point where he should be charged.
#3) The Jan. 6th fiasco is a bit murkier than the other ones, but he still broke his oath as President and was derelict in his duties. Clearly, he CHOSE to not protect and defend the Constitution by scheming to prevent the transfer of power when ALL his legal attempts to do so were exhausted.
But his other crimes are more blatant:
#1) He stole classified US Government documents. Period. Plain and simple. His defense - an unwritten, unspoken, undocumented claim that all documents brought before him are automatically declassified - in his mind? Please Trumpers - how stupid CAN you be? His "other defense" of this was that "workers inadvertently packed these documents and, unbeknownst to him, brought them to Mar-a-Lago. Hmmm, so these highly classified documents just "happened" to be laying around in your stuff to be removed from the Oval? This is an open and shut case. He should already be in jail for this alone.
#2) His phone call to the State of Georgia. This too is an unbelievable act from a sitting President. It's unconscionable, but it's pure Trump. These were his exact words: "All I want to do is this: I just want to find 11,780 votes, which is one more than we have... Fellas, I need 11,000 votes, give me a break." The entire phone call should make anyone feel ashamed that this man was ever elected.
These three things are enough by themselves to lock him up, but it's only the outward tip of his criminal ways. Garland should do the right thing, and let's move on from this idiot once and for all.

Nope. Every criminal should be in prison and some should be executed. Some laws should be overturned and prisoners held for those crimes should be released.

The digital evidence of Clinton’s crimes was conclusive. She wasn’t convicted because government agencies weighed the consequences of such a conviction against the balance of democracy. There’s no way Drumpf’s potential charges don’t go exactly the same way unless the powers that be want a civil war. That won’t be allowed until every legally owned firearm in the country is confiscated. Can you live with that? Do you really understand what is at stake right now?

He was clearly in possession of classified US government documents which he had no right to. His involvement with the Jan. 6th fiasco has been investigated, complete with interviews, sworn testimonies, and the never ending list of 5th amendment declarations by insiders. Regardless of your political leanings, this much reluctance to give information for fear of self-incrimination certainly does not bode well for his insiders. Were this a civil trial, there appears to be more than a preponderance of evidence available to satisfy the standard. Since it's not, the DOJ will determine if they have enough to make criminal charges stick.
Whatever did or didn't happen with Hilary is not what this is about - it's about Trump's alleged criminal behaviors, dereliction of duty, failure to uphold his oath of office, and attempts to influence election officials. This question is specifically about the first three aforementioned actions.
To say it's WHOLLY politically motivated is nonsense. Trump's behaviors should offend intelligent observers from every viewpoint, yet some still cling as if he's somehow "a righteous dude" who's done nothing illegal, immoral, offensive, or just plain stupid. As much as I've tried to give due diligence to verify his claims and his supporters statements, the evidentiary truth is just not forthcoming. Only the "claims" keep coming, and the denials, and the refusals to obey subpoenas and offer truthful answers to simple questions. Who are really the mindless ones at this point?
Thank you for your post. It's clear here that in this forum, Trump supporters are the most vocal. Its hard to believe he still has supporters afte all he has done, both as president as a a lingering president who succeeded brainwashing his minions that he won the election and that it was stoeln--with no proof at all. They have a legal obligation to review it first now before doing anything with their own evidence even if it was sufficient enough. The Jan 6 trials was for the people to see first hand what Trump did and unfortunately one downside is that it prob did slow the DOJ down. There's a legal term that I forget for why the DOJ has to review the evidence of the Jan 6 committee.

They howled about corruption before Chauvin's trisl reached its verdict, and then strangly shut up and celebrated once they got the verdivt they wanted. But after Kyle Rittenhouse's verdict, then they howled about corruption again. So if Trump is charged, I will do these hypocrites the favor of reminding them of corrupt they think this is.
I don't think Trump should be dragged to court over this at all, but yes I would like to see that evidence and hear those witnesses. I just said that I don't think he should be charged, and if he is I will be friendly enough to remind hypocrites who has stated the US justice system is corrupt, that this is corrupt in their opinion.

Yes guilt or innocence matters. If they can prove he actually is guilty, which I think they won't, then he should get what he deserves. I'm not going to chant "ORANGE MAN BAD" but I wouldn't ignore it either.
