To me it’s simple math: 100% consequence to an imperfect Justice system.

We are flawed humans and can’t possibly know for 100% that a person is guilty.

You could even witness the crime personally and not be 100% sure you weren’t hallucinating. Obviously it’s beyond reasonable doubt for you but not 100% consequence like death.

No for two reasons
There have been lots of people who have later been found innocent. It's too late to say sorry once you've hung them.

Secondly juries tend to be less willing to convict if a persons going to die in case they get it wrong. This means more guilty people go free.

Yes, ultimately we both agree. But juries also get to vote on sentencing recommendations. So no guilty person would go free unless the rich defendant convicted dumb juries they were not guilty. Which does happen. People are stupid.

Yes, if the person did something really bad. I’m talking Devaulter bad, never torture though or anything like that. All death penalties should be basic and fast, like that one in Germany or something where you get shot by five dudes.

I think premeditation involves planning and actually doing the crime. Premeditation is probably not important if no crime is ultimately committed since the lack of a crime indicates among other things, a possible presence of self-control. Thinking about things is not a crime. Doing them is sometimes.

Reasonable doubt? Heard of it? We put those people away from society, which is 10x cheaper than death penalty, and appeals can correct inevitable mistakes. Can’t fix death.

It costs $600,000 per year to house a criminal in my state. I would rather feed the homeless.

That sounds overly expensive. The stats I read are usually around 50k the average salary…which isn’t.

But even so appealing a death penalty conviction (which is automatic) costs the state millions. And they still live on death row for decades.
