Given our judicial system is not perfect, why do we have the death penalty?

Since 1973, 197 people have been freed from death row. Some because of prosecutorial (government) misconduct, and some have been freed because the court (government) appointed attorney was incompetent or failed to properly do his job.

As long as our judicial system is prone to mistakes, shouldn't the death penalty be off the table? Life in prison as the max gives the person more time to appeal.

Should the government have control over matters of life and death? Do we trust the government that much?

Yes, it's OK if a few innocent people slip through the cracks and end up on death row
No, it's cruel and unusual for an innocent person to be on death row, little less killed by his own government
