    That is not what SCOTUS said, in fact what SCOTUS said is really just restating what has been true since Day one, and its known as Sovereign immunity, its true not simply of the President but your State Governor too.

    It does not protect the said leaders from unofficial acts, nor did SCOTUS even define what was or was not official merely that it is possible acts can be Official and therefore legitimate. Which is really kind of saying nothing at all, beyond rejecting the idea proposed by the lower courts that nothing is official.


    Basically the point is you can't sue the president for carrying out his constitutionally protected duties simply because you disagree with him. You can sue his agents for carrign out unlawful orders thou, and they can't simply kill you without violating your due process rights.

    This is why the Arkansas ATF raid of Bryan Malinowski is soo controversial as they basically set him up to be killed. If Biden had ordered it they should be charged and investigated but technically it would be Biden's agents not Biden himself. If Biden himself had gone out of his way to abuse such power then Joe Biden should be impeached. As Joe Biden;s own prosecutors would likewise be ordered not to go after him.

      @Sabretooth Believe this guy - because I assume that you want to believe it to draw attention away from Joe Biden shitting his pants at Normandy, but I remember the world being aghast at Trump when the Clinton-financed report called "the Steele dossier" was released. We now know that those were just allegations put together by a paid political opposition researcher, and they could not be verified. And I remember the allegations made against Clarence Thomas when he was nominated to the US Supreme Court, as well as the allegations against other conservative nominees.

      Some people will say anything that fits their narrative. . . truth be damned.

      @Syntosi: How could a President be king if they're still subject to the impeachment process, can't give unlawful orders and is not immune for unofficial acts? Doesn't sound like an absolute ruler to any reasonable person.

      In fact, much of the President's constitutionally-delegated power has actually been usurped from the President since at least 2017. Totally illegal. I don't see any hand wringing from you over that.

      Are they still subject to the impeachment process if they can very realistically stop it at any moment they please? Also how can an order be considered unlawful if the president has automatic legal immunity?

      I mean, the very argument that the president can't give "unlawful orders" is hilarious in the context of legal immunity since said immunity would only exist to cover explicit illegal acts, otherwise it would be legal anyways and not require extra protection. Legal immunity explicitly tells the president that they can give any "unlawful" order that they want.

      @Syntosi: The impeachment process is part of the Constitution, so it's not possible for a President to stop it at any time.

      It is possible to give unlawful orders, but the point of the SCOTUS ruling is that a President's political opponents can't simply prosecute them maliciously because they don't like the President or the President's lawful exercise of their executive powers. That is what is meant by legal immunity in this case.

      It's a requirement to NOT follow an unlawful order (ever heard of the Nuremberg defense?).

      Impeachment is a slow and cumbersome process that can be stopped by just preventing the vote from happening. Also you are assuming there will be anyone to prosecute anyone who follows the presidents orders, which is silly, especially since the president can just pardon them anyways or take over the judiciary as well.

      Dictators does not play by your rules after all.

      @Syntosi: How would a President lawfully "take over the judiciary"? So we're back to unlawful orders, which, again, the President does not have legal immunity for.

      A President cannot stop impeachment- it's a process that is controlled by the House of Representatives. And as for "slow and cumbersome", it took ONE WEEK to impeach Trump in January 2021. But I suppose you'll say criminal prosecution won't be "slow and cumbersome"...

      While it's true that a President's pardon power is very broad, it doesn't apply to cases of impeachment, or crimes at the state level. And there is a process to apply for a pardon.
