It will be interesting to see where this goes. Her claims of economic impropriety and failing to recuse themselves from issues they have a conflict of interest may not be considered as impeachable offenses.

I've never before felt that impeachment of a SCOTUS justice was justified and I still find it hard to justify, but, at the same time, I was thinking for the first time ever that this should be looked into perhaps for Thomas and maybe Alito.

I think the other justices are OK; they have their opinions of law and it is what it is.

However, Thomas and Alito are exhibiting conflicts of interest and are not self-recusing when they should. (*) That's problematic for me and, given the results, I've begun to think about impeachment too this morning before I read this question and discovered AOC was looking into it.

(*) A good example of self-recusal is Associate Justice Elena Kagan who has often had to recuse herself because she was previously the Solicitor General of the United States. The Solicitor General's office represents the United States in the Supreme Court and the "SG" often does the arguing herself. (The current SG is Elizabeth Prelogar.) So, there are times when cases in which Kagan, as SG, was involved and these cases later come to SCOTUS with Kagan now being a justice, she needs to recuse herself to avoid conflict of interest.

Only one Supreme Court Justice has ever been impeached, Samuel Chase, in 1804, and he was acquitted upon trial in the Senate. Those allegations were much more serious and were non-partisan.

Samuel Chase, who was an Associate Justice of the United States Supreme Court from 1796 until his death in 1811, was accused of judicial misconduct and abuse of power during his tenure on the bench. Specifically, Samuel Chase was accused of:

Yes, I have read about it. I think she is right in doing so, because all of those Supreme Court justices have said in the past that no one is above the law, and have just ruled that D Trump is above the law in terms of any presidential official actions. Whilst not a US citizen, shouldn't the judiciary be an independent arm of democratic governance? Don't dictatorships begin by stacking the top court so it gives friendly decisions?

So AOC wanting to impeach the supreme court would seem to be an effort to punish the court for making judgments she doesn't like. The ploy of announcing she is thinking about etc is obviously the initial step in applying heat.

Judiciary's are stacked world wide. It is just a bit more obvious in the US system.

The problem lies in judicial activism. The only way the Judiciary can be an independent arm is if it limits itself to black letter law. As soon as there is activism than a court becomes a political body. It is legislatures that should be making political solutions to political problems.

For my country I would like there to be a constitutional change that limits how judges can interpret law and constitution.

Republicans have already stacked the court with three Trump (Federalist Society) nominees, one in place of what should have been an Obama nominee "because 9 months before a presidential election is too close", and one while voting had started for the next president. McConnell changed the rules in the Senate for SCOTUS nominees so that they could be pushed through with a simple majority, leading to five of the nine being confirmed with votes in the low 50s, one even as low as 50 (RBG got 97).

The rules of the US Senate always meant that nominees the minority party had doubts about needed 60 votes to move to the final vote (which is a simple majority). That is until McConnell changed it to push through three nominees, one with only 50 votes.

Even on Fox News, their experts are saying the immunity decision means a president could legally order a military coup to stay in power. Selling ambassadorships and pardons, also legal.

@goaded Yes. It takes a motion passed through both houses to remove a judge. So it is akin to an impeachment style process.

There is a convention that appointees are OK'ed by the opposition which sort of akin to your system but behind closed doors.

And yes the current gov't can only appoint replacements and not refresh the entire bench. Though the number of justices is prescribed by parliament. It would be possible to stack by increasing from the current 7 to say 30.

It has only become an issue with judical activism finding implied rights. So I think that is what needs to be addressed by constitutional change in our case.

We have an illegal immigrant who stomped on his pregnant wife's belly having a good chance of being released from detention thanks to our High Court. Lots of other repeat alien crims have been released and immediately repeated violent offences.

Anything outside of that can be decided through impeachment and then an actual criminal trial on the federal level.
